폐기물 게시판·관리계획·기록부의 세 문턱과 기재·보관 요건(MARPOL 부속서 V 규칙 10)

MARPOL 부속서 V 규칙 10은 배에 세 가지를 요구합니다. 배출 요건을 알리는 게시판, 선원이 따를 폐기물 관리계획, 그리고 배출과 소각을 적는 폐기물기록부입니다. 셋은 적용 문턱이 서로 다릅니다.

문턱을 섞어 읽으면 결과가 갈립니다. 관리계획 문턱을 기록부에 적용하면 기록부가 필요 없는 배에 기록부를 요구하게 됩니다. 반대로 읽으면 항만국 점검에서 기록부가 없는 배가 됩니다.

본문은 2013년 1월 1일 발효한 결의 MEPC.201(62)의 개정 부속서 V입니다. 여기에 2018년 발효한 MEPC.277(70), 2020년 발효한 MEPC.314(74), 2024년 발효한 MEPC.360(79)가 규칙 10을 손봤습니다. 이 글은 바뀐 뒤의 조문으로 읽고, 어느 결의가 어디를 바꿨는지 밝힙니다.

게시판은 전장 12m부터 걸리고 언어 조건이 붙습니다

1.1 Every ship of 12 m or more in length overall and fixed or floating platforms shall display placards which notify the crew and passengers of the discharge requirements of regulations 3, 4, 5 and 6 of this Annex, as applicable. .2 The placards shall be written in the working language of the ship’s crew and, for ships engaged in voyages to ports or offshore terminals under the jurisdiction of other Parties to the Convention, shall also be in English, French or Spanish.

문턱이 톤수가 아니라 길이입니다. 전장 12m 이상이면 총톤수와 상관없이 게시판을 붙입니다. 고정·부유 플랫폼도 같습니다. 내용은 규칙 3·4·5·6의 배출 요건이고, 그 배에 해당하는 것만 적으면 됩니다.

언어는 두 겹입니다. 선원의 작업언어가 기본입니다. 다른 당사국 관할의 항만이나 해상터미널로 가는 배는 영어·프랑스어·스페인어 중 하나를 더합니다. 국내 항해만 하는 배는 작업언어만으로 충분합니다.

관리계획은 100총톤 또는 15명이고 담당자를 지정해야 합니다

2 Every ship of 100 gross tonnage and above, and every ship which is certified to carry 15 or more persons, and fixed or floating platforms shall carry a garbage management plan which the crew shall follow. This plan shall provide written procedures for minimizing, collecting, storing, processing and disposing of garbage, including the use of the equipment on board. It shall also designate the person or persons in charge of carrying out the plan. Such a plan shall be based on the guidelines developed by the Organization and written in the working language of the crew.

두 문턱이 or로 묶여 있습니다. 100총톤 이상이거나, 15명 이상을 태우도록 증서를 받았으면 걸립니다. 작은 여객선이 두 번째 문턱에 들어옵니다. 사람 수는 실제 승선 인원이 아니라 증서상 정원입니다.

계획에는 다섯 단계의 절차를 적습니다. 줄이기, 모으기, 보관, 처리, 처분입니다. 선내 장비의 사용법도 들어갑니다. 그리고 계획을 실행할 담당자를 지정합니다. 계획은 기구의 지침에 바탕을 두고 선원의 작업언어로 씁니다. 게시판과 달리 영어 병기 조건은 없습니다.

기록부 문턱은 MEPC.360(79)가 400총톤에서 100총톤으로 내렸습니다

2013년 발효 본문의 규칙 10.3은 기록부 대상을 400총톤 이상으로 정했습니다. 2024년 5월 1일 발효한 MEPC.360(79)가 그 첫 문장을 다음으로 바꿨습니다.

3 Every ship of 100 gross tonnage and above and every ship which is certified to carry 15 or more persons engaged in voyages to ports or offshore terminals under the jurisdiction of another Party to the Convention and every fixed or floating platform shall be provided with a Garbage Record Book.

관리계획과 같은 100총톤이 됐지만 조건 하나가 더 붙습니다. 다른 당사국 관할의 항만이나 해상터미널로 가는 배여야 합니다. 국내 항해만 하는 100총톤 배는 관리계획은 갖추되, 기록부는 이 조문으로는 걸리지 않습니다.

같은 항의 둘째 문장은 2020년 10월 1일 발효한 MEPC.314(74)가 바꿨습니다.

The Garbage Record Book, whether as a part of the ship’s official logbook, or as an electronic record book which shall be approved by the Administration taking into account the Guidelines developed by the Organization, or otherwise, shall be in the form specified in appendix II to this Annex:

기록부의 형태는 셋입니다. 공식 항해일지의 일부, 주관청이 승인한 전자기록부, 그 밖의 형태입니다. 어느 쪽이든 양식은 부록 II를 따릅니다. 전자기록부는 주관청 승인이 조건이므로, 소프트웨어를 깔았다고 기록부가 되지는 않습니다.

기록부는 Part I과 Part II로 나뉘고 범주는 아홉과 둘입니다

2018년 3월 1일 발효한 MEPC.277(70)이 부록 II의 범주 구분을 다음으로 바꿨습니다.

3 Description of the garbage Garbage is to be grouped into categories for the purposes of recording in parts I and II of the Garbage Record Book (or ship’s official log-book) as follows: Part I A Plastics B Food wastes C Domestic wastes D Cooking oil E Incinerator ashes F Operational wastes G Animal carcasses H Fishing gear I E-waste Part II J Cargo residues (non-HME) K Cargo residues (HME)

Part I은 모든 배가 씁니다. Part II는 고체 산적화물을 싣는 배만 씁니다. 화물잔류물이 해양환경에 유해한지(HME) 여부로 J와 K가 갈립니다. 2013년 본문에서 화물잔류물은 범주 G 하나였습니다. 이 개정으로 Part II로 옮겨 가며 둘로 나뉘었고, E-waste 범주 I도 이때 들어왔습니다.

기재 항목은 바다 배출·소각·육상 인도로 나뉩니다

누가 언제 서명하는지는 2013년 본문의 규칙 10.3.1이 정합니다.

.1 Each discharge into the sea or to a reception facility, or a completed incineration, shall be promptly recorded in the Garbage Record Book and signed for on the date of the discharge or incineration by the officer in charge. Each completed page of the Garbage Record Book shall be signed by the master of the ship. The entries in the Garbage Record Book shall be at least in English, French or Spanish. Where the entries are also made in an official language of the State whose flag the ship is entitled to fly, the entries in that language shall prevail in case of a dispute or discrepancy;

담당 사관이 그날 서명하고, 선장은 완성된 쪽마다 서명합니다. MEPC.314(74)는 둘째 문장의 each completed page 뒤에 or group of electronic entries를 넣었습니다. 전자기록부에서는 쪽 대신 기재 묶음 단위로 선장이 서명합니다. 언어는 영어·프랑스어·스페인어 중 하나가 최소입니다. 기국 공용어를 함께 적으면 다툼이 있을 때 그쪽이 우선합니다.

무엇을 적는지는 MEPC.277(70)이 세 항으로 나눠 다시 썼습니다.

.2 The entry for each discharge into the sea under regulations 4, 5, 6 or section 5.2 of chapter 5 of part II-A of the Polar Code shall include date and time, position of the ship (latitude and longitude), category of the garbage and the estimated amount (in cubic metres) discharged. For discharge of cargo residues the discharge start and stop positions shall be recorded in addition to the foregoing; .3 The entry for each completed incineration shall include date and time and position of the ship (latitude and longitude) at the start and stop of incineration, categories of garbage incinerated and the estimated amount incinerated for each category in cubic metres; .4 The entry for each discharge to a port reception facility or another ship shall include date and time of discharge, port or facility or name of ship, categories of garbage discharged, and the estimated amount discharged for each category in cubic metres;

세 경우의 공통 항목은 일시, 범주, 세제곱미터 단위의 추정량입니다. 다른 것은 위치의 형태입니다. 바다 배출은 한 위치를 적되, 화물잔류물은 시작과 종료 위치를 둘 다 적습니다. 소각은 시작과 종료의 일시와 위치를 모두 적습니다. 육상 인도는 위치 대신 항만이나 시설, 또는 받은 배의 이름을 적습니다. 2013년 본문의 3.2는 이 셋을 한 문장으로 뭉뚱그려 두었는데, 개정이 경우마다 항목을 다르게 못 박았습니다.

보관은 마지막 기재일부터 2년이고 영수증이 함께 묶입니다

.3 The Garbage Record Book shall be kept on board the ship or the fixed or floating platform, and in such a place as to be readily available for inspection at all reasonable times. This document shall be preserved for a period of at least two years from the date of the last entry made in it;

2013년 본문의 3.3입니다. MEPC.277(70)이 이 항을 3.5로 옮기고 Garbage Record Book 뒤에 along with receipts obtained from reception facilities를 넣었습니다. 수용시설에서 받은 영수증이 기록부와 같은 보관 의무를 집니다. 기간은 마지막 기재일부터 2년입니다. 책을 다 쓴 날이 아니라 마지막 기재일이 기산점입니다.

사고로 잃은 폐기물도 기재합니다. MEPC.360(79)가 다음으로 바꾼 3.6입니다.

.6 In the event of any discharge or accidental loss referred to in regulation 7 of this annex an entry shall be made in the Garbage Record Book, or in the case of any ship of less than 100 gross tonnage, an entry shall be made in the ship’s official logbook of the date and time of occurrence, port or position of the ship at time of occurrence (latitude, longitude and water depth if known), the reason for the discharge or loss, details of the items discharged or lost, categories of garbage discharged or lost, estimated amount for each category in cubic metres, reasonable precautions taken to prevent or minimize such discharge or accidental loss and general remarks.

규칙 7의 예외 배출과 사고 유실은 기록부에 적습니다. 기록부가 없는 100총톤 미만 배는 공식 항해일지에 적습니다. 이 문턱도 기록부 문턱과 함께 400에서 100으로 내려왔습니다. 적을 것은 일반 기재보다 많습니다. 수심, 사유, 품목 상세, 취한 예방조치까지 들어갑니다. 어구 유실이 해양환경이나 항행에 중대한 위협이 되면 규칙 10.6에 따라 기국에 보고합니다. 연안국 관할수역이면 그 연안국에도 보고합니다.

면제는 주관청의 재량이고 열람은 항만국의 권한입니다

4 The Administration may waive the requirements for Garbage Record Books for: .1 Any ship engaged on voyages of one (1) hour or less in duration which is certified to carry 15 or more persons; or .2 Fixed or floating platforms.

면제 대상은 둘뿐입니다. 한 시간 이내 항해를 하는 정원 15명 이상의 배, 그리고 플랫폼입니다. may waive이므로 주관청이 면제해 줘야 성립합니다. 관리계획과 게시판에는 면제 조항이 없습니다.

규칙 10.5는 당사국의 관할 당국이 항만에서 기록부나 항해일지를 열람하고 사본을 만들 수 있게 합니다. 선장에게 그 사본이 진본과 같다는 확인을 요구할 수 있습니다. 확인된 사본은 법적 절차에서 증거가 됩니다. 열람은 배를 부당하게 지체시키지 않게 신속히 해야 합니다.
