폐기물 해상 배출 조건과 특별해역의 차이(MARPOL 부속서 V 규칙 3·4·6)

MARPOL 부속서 V는 폐기물을 바다에 버리는 행위를 원칙적으로 금지하고, 규칙 4와 규칙 6에서 종류별로 예외를 엽니다. 규칙 4는 특별해역 밖, 규칙 6은 특별해역 안입니다. 같은 음식물이라도 어느 바다에 있느냐에 따라 거리와 처리 조건이 달라집니다.

특별해역은 규칙 1.14가 여덟 곳을 정합니다. 지중해, 발트해, 흑해, 홍해, 걸프 해역, 북해, 남극 해역, 광역 카리브해입니다. 특별해역 조건은 전 세계 공통 의무가 아니라 그 해역 안에서만 걸리므로, 항로가 특별해역에 들어가는지부터 확인해야 합니다. 규칙 8.2.2에 따라 각 해역의 규칙 6은 연안 당사국의 수용시설 통지를 받아 기구가 정한 날부터 효력을 가집니다.

본문은 2013년 1월 1일 발효한 결의 MEPC.201(62)입니다. 2018년 3월 1일 발효한 MEPC.277(70)이 화물잔류물의 유해성 판정 기준을 부록 I로 옮기고 선적자 신고를 넣었습니다. 아래는 바뀐 뒤의 조문입니다.

출발점은 전면 금지이고 플라스틱과 식용유에는 예외가 없습니다

1 Discharge of all garbage into the sea is prohibited, except as provided otherwise in regulations 4, 5, 6 and 7 of this Annex. 2 Except as provided in regulation 7 of this Annex, discharge into the sea of all plastics, including but not limited to synthetic ropes, synthetic fishing nets, plastic garbage bags and incinerator ashes from plastic products is prohibited. 3 Except as provided in regulation 7 of this Annex, the discharge into the sea of cooking oil is prohibited.

규칙 3의 구조가 아래 모든 조건을 읽는 틀입니다. 제1항은 모든 폐기물의 배출을 금지하고, 규칙 4·5·6·7만이 예외를 엽니다. 제2항과 제3항은 플라스틱과 식용유를 따로 적어 규칙 4와 6의 예외에서도 빼냅니다. 남는 예외는 규칙 7의 안전·사고 예외뿐입니다.

플라스틱의 범위는 규칙 1.13이 정합니다. 합성 로프, 합성 어망, 비닐봉지, 플라스틱 제품을 태운 소각재까지 all plastics에 들어갑니다. 소각재는 범주 E지만, 플라스틱을 태운 재라면 배출할 수 없습니다.

특별해역 밖에서는 음식물이 3해리와 12해리로 갈립니다

1 Discharge of the following garbage into the sea outside special areas shall only be permitted while the ship is en route and as far as practicable from the nearest land, but in any case not less than: .1 3 nautical miles from the nearest land for food wastes which have been passed through a comminuter or grinder. Such comminuted or ground food wastes shall be capable of passing through a screen with openings no greater than 25 mm. .2 12 nautical miles from the nearest land for food wastes that have not been treated in accordance with subparagraph .1 above. .3 12 nautical miles from the nearest land for cargo residues that cannot be recovered using commonly available methods for unloading. These cargo residues shall not contain any substances classified as harmful to the marine environment, taking into account guidelines developed by the Organization. .4 For animal carcasses, discharge shall occur as far from the nearest land as possible, taking into account the guidelines developed by the Organization.

모든 항목에 공통 조건이 둘 있습니다. 배가 en route여야 하고, 가장 가까운 육지에서 실행 가능한 한 멀어야 합니다. 규칙 1.5의 en route는 단순히 움직이는 상태가 아닙니다. 배출물이 합리적으로 넓은 해역에 퍼지도록 항행 중인 상태입니다. 정박 중이나 표류 중의 배출은 이 조건을 채우지 못합니다.

음식물은 처리 여부가 거리를 정합니다. 분쇄기를 거쳐 25mm 체를 통과하는 상태면 3해리, 아니면 12해리입니다. 화물잔류물은 12해리에 더해 유해물질이 없어야 합니다. MEPC.277(70)은 .3의 둘째 문장을 고쳤습니다. 지침을 고려하라는 taking into account guidelines developed by the Organization이 빠졌습니다. 대신 in accordance with the criteria set out in appendix I가 들어갔습니다. 판정 기준이 권고 지침에서 부속서 본문의 부록으로 올라온 것입니다.

같은 결의가 규칙 4에 새 제3항을 넣고 기존 제3항을 제4항으로 밀었습니다.

3 Solid bulk cargoes as defined in regulation VI/1-1.2 of the International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended, other than grain, shall be classified in accordance with appendix I of this Annex, and declared by the shipper as to whether or not they are harmful to the marine environment.

곡물을 뺀 고체 산적화물은 선적자가 부록 I에 따라 분류하고 유해 여부를 신고합니다. 배는 그 신고를 받아 화물잔류물을 범주 J(non-HME)와 K(HME)로 나눠 적습니다. 신고가 없으면 배가 잔류물을 바다에 버릴 근거가 없습니다.

특별해역 안에서는 음식물 12해리에 분쇄가 붙고 화물잔류물은 여섯 조건을 다 채워야 합니다

1 Discharge of the following garbage into the sea within special areas shall only be permitted while the ship is en route and as follows: .1 Discharge into the sea of food wastes as far as practicable from the nearest land, but not less than 12 nautical miles from the nearest land or the nearest ice shelf. Food wastes shall be comminuted or ground and shall be capable of passing through a screen with openings no greater than 25 mm. Food wastes shall not be contaminated by any other garbage type. Discharge of introduced avian products, including poultry and poultry parts, is not permitted in the Antarctic area unless it has been treated to be made sterile.

밖에서는 분쇄하면 3해리였던 음식물이, 안에서는 분쇄해도 12해리입니다. 분쇄하지 않은 음식물은 특별해역에서 배출할 수 없습니다. 거리 기준에 the nearest ice shelf가 더해지고, 다른 폐기물에 오염되지 않아야 한다는 조건이 붙습니다. 남극 해역에서는 가금류 제품을 멸균하지 않으면 배출할 수 없습니다.

화물잔류물은 규칙 6.1.2의 조건을 전부 채워야 합니다. MEPC.277(70)이 조건 셋을 새로 쓰고 기존 셋을 뒤로 밀어 여섯이 됐습니다. 새로 쓴 조건은 다음과 같습니다.

.1 Cargo residues contained in hold washing water do not include any substances classified as harmful to the marine environment according to the criteria set out in appendix I of this Annex; .2 Solid bulk cargoes as defined in regulation VI/1-1.2 of the International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended, other than grain, shall be classified in accordance with appendix I of this Annex, and declared by the shipper as to whether or not they are harmful to the marine environment; .3 Cleaning agents or additives contained in hold washing water do not include any substances classified as harmful to the marine environment taking into account guidelines developed by the Organization;

뒤로 밀린 셋은 2013년 본문의 조건입니다. 출발항과 다음 목적항이 모두 특별해역 안에 있고 그 사이에 해역 밖으로 나가지 않을 것(.4), 그 항만들에 적절한 수용시설이 없을 것(.5), 그리고 거리 조건(.6)입니다. 거리 조건은 다음으로 고쳐 썼습니다.

.6 Where the conditions of subparagraphs .2.1 to .2.5 of this paragraph have been fulfilled, discharge of cargo hold washing water containing residues shall be made as far as practicable from the nearest land or the nearest ice shelf and not less than 12 nautical miles from the nearest land or the nearest ice shelf.

여섯 조건은 모두 채워야 합니다. 수용시설이 있는 항만으로 가는 배는 다섯째 조건에서 막힙니다. 특별해역 안의 화물잔류물 배출은 수용시설이 없을 때의 대안이지 통상 처리 경로가 아닙니다.

섞이면 더 엄격한 쪽을 따릅니다

3 When garbage is mixed with or contaminated by other substances prohibited from discharge or having different discharge requirements, the more stringent requirements shall apply.

2013년 본문 규칙 4의 제3항이고, MEPC.277(70)이 제4항으로 번호를 바꿨습니다. 규칙 6.4에 같은 문장이 있습니다. 음식물에 비닐이 섞이면 음식물이 아니라 플라스틱의 규칙을 따릅니다. 즉 배출이 막힙니다. 분리 보관이 배출 조건의 전제가 되는 이유입니다.

예외는 규칙 7이 닫아 둡니다

규칙 7.1은 네 가지 상황에 규칙 3·4·5·6을 적용하지 않습니다. 배와 인명의 안전을 위한 배출, 손상으로 인한 사고 유실, 합리적 예방조치를 했는데도 잃은 어구, 해양환경 보호나 배의 안전을 위한 어구 투기입니다. 그리고 en route 조건에 예외가 하나 있습니다.

.1 The en route requirements of regulations 4 and 6 shall not apply to the discharge of food wastes where it is clear the retention on board of these food wastes presents an imminent health risk to the people on board.

보관이 승선자의 건강에 임박한 위험이 될 때, 음식물에 한해 항행 중 조건을 풉니다. 거리 조건까지 푸는 것은 아닙니다. 이런 예외 배출은 규칙 10.3.6에 따라 기록부에 사유와 함께 적습니다.

이 글은 MEPC.201(62)의 규칙 3·4·6·7과 MEPC.277(70)이 바꾼 부분까지 다룹니다. 극지 코드의 폐기물 규정과 그 뒤의 개정은 다루지 않습니다. 부록 I의 유해성 판정 기준은 유엔 GHS 분류를 따르므로, 선적자 신고서의 분류 근거를 그 기준에 대조해야 합니다. 규칙 6.3은 남극 해역에 대해 들어가기 전 폐기물을 전부 보관할 용량과, 떠난 뒤 수용시설에 인도할 약정을 추가로 요구합니다.
