廃棄物の掲示板・管理計画・記録簿の三つの敷居と記載・保管の要件（MARPOL附属書V規則10）

MARPOL附属書V規則10は船に三つのものを求めます。排出要件を知らせる掲示板、船員が従う廃棄物管理計画、そして排出と焼却を記載する廃棄物記録簿です。三つは適用の敷居がそれぞれ違います。

敷居を混ぜて読むと結果が分かれます。管理計画の敷居を記録簿に当てはめれば、記録簿の要らない船に記録簿を求めることになります。逆に読めば、寄港国検査の場で記録簿のない船になります。

本文は2013年1月1日に発効した決議MEPC.201(62)の改正附属書Vです。ここに2018年発効のMEPC.277(70)、2020年発効のMEPC.314(74)、2024年発効のMEPC.360(79)が規則10に手を入れました。この記事は改正後の条文で読み、どの決議がどこを変えたかを明らかにします。

掲示板は全長12mから掛かり、言語の条件が付きます

1.1 Every ship of 12 m or more in length overall and fixed or floating platforms shall display placards which notify the crew and passengers of the discharge requirements of regulations 3, 4, 5 and 6 of this Annex, as applicable. .2 The placards shall be written in the working language of the ship’s crew and, for ships engaged in voyages to ports or offshore terminals under the jurisdiction of other Parties to the Convention, shall also be in English, French or Spanish.

敷居はトン数ではなく長さです。全長12m以上なら総トン数にかかわらず掲示板を掲げます。固定又は浮遊プラットフォームも同じです。内容は規則3・4・5・6の排出要件で、その船に当てはまるものだけを書けば足ります。

言語は二層です。船員の作業言語が基本です。他の締約国の管轄する港や沖合ターミナルへ向かう船は、英語・フランス語・スペイン語のいずれかを加えます。国内航海だけの船は作業言語だけで足ります。

管理計画は100総トン又は15人で、担当者を指定しなければなりません

2 Every ship of 100 gross tonnage and above, and every ship which is certified to carry 15 or more persons, and fixed or floating platforms shall carry a garbage management plan which the crew shall follow. This plan shall provide written procedures for minimizing, collecting, storing, processing and disposing of garbage, including the use of the equipment on board. It shall also designate the person or persons in charge of carrying out the plan. Such a plan shall be based on the guidelines developed by the Organization and written in the working language of the crew.

二つの敷居がorで結ばれています。100総トン以上か、15人以上を乗せる証書を受けていれば掛かります。小さな旅客船が二つ目の敷居で入ってきます。人数は実際の乗船者数ではなく、証書上の定員です。

計画には五段階の手順を書きます。減量、収集、保管、処理、処分です。船内設備の使い方も入ります。そして計画を実行する担当者を指定します。計画は機関の指針に基づき、船員の作業言語で書きます。掲示板と違い、英語を併記する条件はありません。

記録簿の敷居はMEPC.360(79)が400総トンから100総トンに下げました

2013年発効の本文の規則10.3は、記録簿の対象を400総トン以上と定めていました。2024年5月1日に発効したMEPC.360(79)が、その第一文を次のように置き換えました。

3 Every ship of 100 gross tonnage and above and every ship which is certified to carry 15 or more persons engaged in voyages to ports or offshore terminals under the jurisdiction of another Party to the Convention and every fixed or floating platform shall be provided with a Garbage Record Book.

管理計画と同じ100総トンになりましたが、条件が一つ余分に付きます。他の締約国の管轄する港や沖合ターミナルへ向かう船でなければなりません。国内航海だけの100総トンの船は、管理計画は備えますが、記録簿はこの条文では掛かりません。

同じ項の第二文は、2020年10月1日に発効したMEPC.314(74)が置き換えました。

The Garbage Record Book, whether as a part of the ship’s official logbook, or as an electronic record book which shall be approved by the Administration taking into account the Guidelines developed by the Organization, or otherwise, shall be in the form specified in appendix II to this Annex:

記録簿の形は三つです。公式航海日誌の一部、主管庁が承認した電子記録簿、その他の形です。いずれにせよ様式は附録IIに従います。電子記録簿は主管庁の承認が条件なので、ソフトウェアを入れただけでは記録簿になりません。

記録簿は第I部と第II部に分かれ、区分は九つと二つです

2018年3月1日に発効したMEPC.277(70)が、附録IIの区分の説明を次のように置き換えました。

3 Description of the garbage Garbage is to be grouped into categories for the purposes of recording in parts I and II of the Garbage Record Book (or ship’s official log-book) as follows: Part I A Plastics B Food wastes C Domestic wastes D Cooking oil E Incinerator ashes F Operational wastes G Animal carcasses H Fishing gear I E-waste Part II J Cargo residues (non-HME) K Cargo residues (HME)

第I部はすべての船が使います。第II部は固体ばら積み貨物を積む船だけが使います。貨物残渣が海洋環境に有害（HME）かどうかでJとKが分かれます。2013年発効の本文では貨物残渣は区分Gの一つだけでした。この改正で第II部へ移って二つに分かれ、電気電子機器廃棄物の区分Iもこのとき入りました。

記載項目は海への排出・焼却・陸上への引渡しで分かれます

誰がいつ署名するかは、2013年発効の本文の規則10.3.1が定めます。

.1 Each discharge into the sea or to a reception facility, or a completed incineration, shall be promptly recorded in the Garbage Record Book and signed for on the date of the discharge or incineration by the officer in charge. Each completed page of the Garbage Record Book shall be signed by the master of the ship. The entries in the Garbage Record Book shall be at least in English, French or Spanish. Where the entries are also made in an official language of the State whose flag the ship is entitled to fly, the entries in that language shall prevail in case of a dispute or discrepancy;

担当職員がその日に署名し、船長は完成したページごとに署名します。MEPC.314(74)は第二文のeach completed pageの後にor group of electronic entriesを挿入しました。電子記録簿ではページの代わりに記載のまとまりを単位として船長が署名します。言語は英語・フランス語・スペイン語のいずれかが最低限です。旗国の公用語を併せて書けば、争いがあるときはそちらが優先します。

何を書くかは、MEPC.277(70)が三つの号に分けて書き直しました。

.2 The entry for each discharge into the sea under regulations 4, 5, 6 or section 5.2 of chapter 5 of part II-A of the Polar Code shall include date and time, position of the ship (latitude and longitude), category of the garbage and the estimated amount (in cubic metres) discharged. For discharge of cargo residues the discharge start and stop positions shall be recorded in addition to the foregoing; .3 The entry for each completed incineration shall include date and time and position of the ship (latitude and longitude) at the start and stop of incineration, categories of garbage incinerated and the estimated amount incinerated for each category in cubic metres; .4 The entry for each discharge to a port reception facility or another ship shall include date and time of discharge, port or facility or name of ship, categories of garbage discharged, and the estimated amount discharged for each category in cubic metres;

三つの場合に共通する項目は、日時、区分、立方メートル単位の推定量です。違うのは位置の形です。海への排出は一つの位置を書きますが、貨物残渣は開始と終了の位置を両方書きます。焼却は開始と終了の日時と位置をすべて書きます。陸上への引渡しは位置の代わりに港や施設、又は受け取った船の名前を書きます。2013年発効の本文の3.2はこの三つを一文にまとめていましたが、改正が場合ごとに項目を別々に定めました。

保管は最後の記載日から2年で、受領証が一緒に綴じられます

.3 The Garbage Record Book shall be kept on board the ship or the fixed or floating platform, and in such a place as to be readily available for inspection at all reasonable times. This document shall be preserved for a period of at least two years from the date of the last entry made in it;

2013年発効の本文の3.3です。MEPC.277(70)がこの号を3.5に移し、Garbage Record Bookの後にalong with receipts obtained from reception facilitiesを挿入しました。受入施設から受け取った受領証が、記録簿と同じ保管義務を負います。期間は最後の記載日から2年です。帳簿を使い切った日ではなく、最後の記載日が起算点です。

事故で失った廃棄物も記載します。MEPC.360(79)が次のように置き換えた3.6です。

.6 In the event of any discharge or accidental loss referred to in regulation 7 of this annex an entry shall be made in the Garbage Record Book, or in the case of any ship of less than 100 gross tonnage, an entry shall be made in the ship’s official logbook of the date and time of occurrence, port or position of the ship at time of occurrence (latitude, longitude and water depth if known), the reason for the discharge or loss, details of the items discharged or lost, categories of garbage discharged or lost, estimated amount for each category in cubic metres, reasonable precautions taken to prevent or minimize such discharge or accidental loss and general remarks.

規則7の例外的な排出と事故による流失は記録簿に書きます。記録簿のない100総トン未満の船は公式航海日誌に書きます。この敷居も記録簿の敷居と一緒に400から100へ下がりました。書くことは通常の記載より多くなります。水深、理由、品目の詳細、取った予防措置まで入ります。漁具の流失が海洋環境や航行に重大な脅威となるときは、規則10.6により旗国に報告します。沿岸国の管轄水域なら、その沿岸国にも報告します。

免除は主管庁の裁量で、閲覧は寄港国の権限です

4 The Administration may waive the requirements for Garbage Record Books for: .1 Any ship engaged on voyages of one (1) hour or less in duration which is certified to carry 15 or more persons; or .2 Fixed or floating platforms.

免除の対象は二つだけです。一時間以内の航海をする定員15人以上の船と、プラットフォームです。may waiveですから、主管庁が免除してはじめて成立します。管理計画と掲示板には免除の条項がありません。

規則10.5は、締約国の権限のある機関が港で記録簿や航海日誌を閲覧し、写しを作ることを認めます。船長に対し、その写しが原本と同じであることの証明を求められます。証明された写しは法的手続で証拠になります。閲覧は船を不当に遅延させないよう迅速に行わなければなりません。

確認しておくこと

この記事は、決議MEPC.201(62)の規則10とその附録に、MEPC.277(70)・MEPC.314(74)・MEPC.360(79)が変えた部分を重ねて読んだものです。発効日は順に2013年1月1日、2018年3月1日、2020年10月1日、2024年5月1日です。その後の改正と統合版は扱いません。

記録簿の様式の欄の構成は附録IIに、管理計画の作成指針は機関の指針に、電子記録簿の承認基準はMEPC.312(74)にあります。旗国が統合版をどう公布したかと、電子記録簿の承認手続は、その旗国に確認する必要があります。
