회사가 바뀌는 날 임시 DOC와 임시 SMC가 발급되는 순서와 기간(ISM 코드 14장)
배가 새 관리회사로 넘어가는 날, 그 배의 SMC는 전 회사의 DOC에 묶여 있던 증서입니다. ISM 코드 13.1은 배를 운항하는 회사가 그 배에 해당하는 DOC 또는 임시 DOC를 가져야 한다고 적고, SMC 양식은 DOC가 유효한 동안만 증서가 유효하다고 적습니다. 회사가 바뀌면 그 연결이 끊깁니다.
그 공백을 메우는 것이 14장의 임시 증서입니다. 14장은 결의 MSC.104(73)가 새로 더한 장이고, 2002년 7월 1일에 발효되었습니다. 임시 DOC는 회사에, 임시 SMC는 배에 나오며, 기간과 조건이 서로 다릅니다.
이 글은 회사가 바뀌는 날을 기준으로 순서를 따라갑니다. 어느 증서가 먼저 나오는지, 각각 얼마나 가는지, 발급 전에 무엇을 검증하는지, 그리고 둘이 어떻게 묶여 있는지입니다.
임시 DOC는 회사가 새로 생기거나 선종을 더할 때 12개월까지 나옵니다
14.1 An Interim Document of Compliance may be issued to facilitate initial implementation of this Code when: .1 a Company is newly established; or .2 new ship types are to be added to an existing Document of Compliance, following verification that the Company has a safety management system that meets the objectives of paragraph 1.2.3 of this Code, provided the Company demonstrates plans to implement a safety management system meeting the full requirements of this Code within the period of validity of the Interim Document of Compliance.
사유는 둘입니다. 회사가 새로 설립된 경우, 그리고 기존 DOC에 새 선종을 더하는 경우입니다. 배를 새로 인수한 기존 회사가 같은 선종을 이미 DOC에 갖고 있다면 임시 DOC는 필요 없습니다. 그 회사의 기존 DOC가 그 배에 그대로 해당합니다.
발급 조건도 둘입니다. 회사의 안전관리체제가 1.2.3의 목표를 충족한다는 검증, 그리고 임시 DOC 유효기간 안에 코드의 전체 요건을 갖춘 체제를 시행할 계획의 증명입니다.
Such an Interim Document of Compliance should be issued for a period not exceeding 12 months by the Administration or by an organization recognized by the Administration or, at the request of the Administration, by another Contracting Government. A copy of the Interim Document of Compliance should be placed on board in order that the master of the ship, if so requested, may produce it for verification by the Administration or by an organization recognized by the Administration or for the purposes of the control referred to in regulation IX/6.2 of the Convention. The copy of the document is not required to be authenticated or certified.
기간은 12개월을 넘지 못합니다. 정식 DOC처럼 사본을 배에 두고, 사본에 공증이나 인증은 필요 없습니다.
임시 SMC는 세 가지 경우에 6개월까지 나오고 특별한 경우 6개월을 더 받습니다
14.2 An Interim Safety Management Certificate may be issued: .1 to new ships on delivery; or .2 when a Company takes on responsibility for the operation of a ship which is new to the Company; or .3 when a ship changes flag. Such an Interim Safety Management Certificate should be issued for a period not exceeding 6 months by the Administration or an organization recognized by the Administration or, at the request of the Administration, by another Contracting Government.
사유는 셋입니다. 신조선 인도, 회사가 자기에게 새로운 배의 운항 책임을 맡는 경우, 그리고 선적 변경입니다. 관리회사가 바뀌는 경우는 두 번째입니다. 기간은 6개월을 넘지 못합니다.
14.3 An Administration or, at the request of the Administration, another Contracting Government may, in special cases, extend the validity of an Interim Safety Management Certificate for a further period which should not exceed 6 months from the date of expiry.
연장은 주관청 또는 주관청의 요청을 받은 다른 체약국 정부가 특별한 경우에만 하고, 만료일에서 6개월을 넘지 못합니다. 임시 SMC 양식에는 연장란이 따로 있습니다. 14장에 임시 DOC의 연장 조항은 없습니다.
임시 SMC 전에 여섯 가지를 검증합니다
14.4 An Interim Safety Management Certificate may be issued following verification that: .1 the Document of Compliance, or the Interim Document of Compliance, is relevant to the ship concerned; .2 the safety management system provided by the Company for the ship concerned includes key elements of this Code and has been assessed during the audit for issuance of the Document of Compliance or demonstrated for issuance of the Interim Document of Compliance; .3 the Company has planned the audit of the ship within three months; .4 the master and officers are familiar with the safety management system and the planned arrangements for its implementation; .5 instructions, which have been identified as being essential, are provided prior to sailing; and .6 relevant information on the safety management system has been given in a working language or languages understood by the ship’s personnel.
여섯 항목은 순서대로 읽힙니다. 첫째, DOC 또는 임시 DOC가 그 배에 해당해야 합니다. 회사 쪽 증서가 먼저 있어야 배 쪽 증서가 나옵니다. 둘째, 그 배에 준 안전관리체제가 코드의 핵심 요소를 담고 있고, DOC 심사에서 평가되었거나 임시 DOC 발급 때 입증되었어야 합니다.
셋째, 회사가 3개월 안에 그 배의 심사를 계획해 두어야 합니다. MSC.273(85)는 이 항에 internal을 넣어 그 심사가 회사의 내부심사임을 분명히 했습니다. 넷째, 선장과 사관이 안전관리체제와 시행 계획에 친숙해야 합니다. 다섯째, 필수로 식별된 지침이 출항 전에 제공되어야 합니다. 여섯째, 안전관리체제에 관한 정보가 선원이 이해하는 작업 언어로 주어져야 합니다.
넷째부터 여섯째까지는 배 위에서 확인하는 것입니다. 회사가 바뀌는 날 선장과 사관이 새 체제를 모르면 임시 SMC의 조건이 채워지지 않습니다.
사무소 심사가 먼저이고 배는 그 뒤입니다
주관청 쪽 절차는 결의 A.1118(30)의 지침 4.2에 있습니다.
4.2.3 The process of interim verification for the issuance of an Interim Document of Compliance undertaken by the Administration would require an assessment at the company’s offices in accordance with paragraph 14.1 of the ISM Code.
4.2.4 On satisfactory completion of the assessment of the shoreside safety management system, arrangements/planning may commence for the assessment of applicable ships in the company’s fleet.
회사가 주관청에 임시 인증을 신청하면, 주관청은 14.1에 따라 회사 사무소를 먼저 평가합니다. 육상 체제의 평가가 만족스럽게 끝난 뒤에야 선대의 배에 대한 평가 준비가 시작됩니다. 배의 임시 검증은 14.4에 따라 그 배에 안전관리체제가 갖춰졌는지를 봅니다.
4.2.6 On satisfactory completion of the interim verification, an Interim Document of Compliance will be issued to the company; copies should be made available by the company to each shoreside premises and each applicable ship in the company’s fleet. As each ship is assessed and issued with an Interim Safety Management Certificate, a copy of the certificate should also be forwarded to the company’s head office.
임시 DOC가 나오면 회사가 사본을 육상 사무소마다, 그리고 해당하는 배마다 보냅니다. 배가 임시 SMC를 받으면 그 사본은 반대로 본사로 올라갑니다. 증서 사본이 양방향으로 오가는 구조입니다.
임시 증서도 DOC가 철회되면 함께 사라집니다
13.5.1 All associated Safety Management Certificates and/or Interim Safety Management Certificates should also be withdrawn if the Document of Compliance is withdrawn.
13.5.1은 정식 SMC와 임시 SMC를 구별하지 않습니다. DOC가 철회되면 둘 다 철회됩니다. 임시 SMC 양식도 DOC 또는 임시 DOC가 유효한 동안만 증서가 유효하다고 적습니다. 회사 쪽 증서가 임시 DOC라면 그 임시 DOC가 만료되는 순간 임시 SMC도 유효하지 않게 됩니다.
