会社が変わる日に暫定DOCと暫定SMCが発給される順序と期間（ISMコード14章）

船が新しい管理会社に移る日、その船のSMCは前の会社のDOCに結び付いていた証書です。ISMコードの13.1は、船を運航する会社がその船に該当するDOCまたは暫定DOCを持つべきだと書き、SMCの様式はDOCが有効な間だけ証書が有効だと書きます。会社が変わるとそのつながりが切れます。

その空白を埋めるのが14章の暫定証書です。14章は決議MSC.104(73)が新たに加えた章で、2002年7月1日に発効しました。暫定DOCは会社に、暫定SMCは船に出され、期間と条件が互いに異なります。

この記事は会社が変わる日を基準に順序をたどります。どの証書が先に出るか、それぞれどれだけ続くか、発給前に何を検証するか、そして二つがどう結び付いているかです。

暫定DOCは会社が新設されるか船種を加えるときに12か月まで出ます

14.1 An Interim Document of Compliance may be issued to facilitate initial implementation of this Code when: .1 a Company is newly established; or .2 new ship types are to be added to an existing Document of Compliance, following verification that the Company has a safety management system that meets the objectives of paragraph 1.2.3 of this Code, provided the Company demonstrates plans to implement a safety management system meeting the full requirements of this Code within the period of validity of the Interim Document of Compliance.

事由は二つです。会社が新たに設立された場合、そして既存のDOCに新しい船種を加える場合です。船を新たに引き受けた既存の会社が同じ船種をすでにDOCに持っていれば、暫定DOCは要りません。その会社の既存のDOCがその船にそのまま該当します。

発給の条件も二つです。会社の安全管理システムが1.2.3の目的を満たすという検証、そして暫定DOCの有効期間内にコードの全要件を満たすシステムを実施する計画の証明です。

Such an Interim Document of Compliance should be issued for a period not exceeding 12 months by the Administration or by an organization recognized by the Administration or, at the request of the Administration, by another Contracting Government. A copy of the Interim Document of Compliance should be placed on board in order that the master of the ship, if so requested, may produce it for verification by the Administration or by an organization recognized by the Administration or for the purposes of the control referred to in regulation IX/6.2 of the Convention. The copy of the document is not required to be authenticated or certified.

期間は12か月を超えられません。正式なDOCと同じく写しを船に置き、写しに公証や認証は要りません。

暫定SMCは三つの場合に6か月まで出され、特別な場合に6か月を追加できます

14.2 An Interim Safety Management Certificate may be issued: .1 to new ships on delivery; or .2 when a Company takes on responsibility for the operation of a ship which is new to the Company; or .3 when a ship changes flag. Such an Interim Safety Management Certificate should be issued for a period not exceeding 6 months by the Administration or an organization recognized by the Administration or, at the request of the Administration, by another Contracting Government.

事由は三つです。新造船の引渡し、会社が自らにとって新しい船の運航責任を引き受ける場合、そして旗国の変更です。管理会社が変わる場合は二つ目です。期間は6か月を超えられません。

14.3 An Administration or, at the request of the Administration, another Contracting Government may, in special cases, extend the validity of an Interim Safety Management Certificate for a further period which should not exceed 6 months from the date of expiry.

延長は主管庁または主管庁の要請を受けた他の締約国政府が特別な場合にだけ行い、満了日から6か月を超えられません。暫定SMCの様式には延長欄が別にあります。14章に暫定DOCの延長条項はありません。

暫定SMCの前に六つのことを検証します

14.4 An Interim Safety Management Certificate may be issued following verification that: .1 the Document of Compliance, or the Interim Document of Compliance, is relevant to the ship concerned; .2 the safety management system provided by the Company for the ship concerned includes key elements of this Code and has been assessed during the audit for issuance of the Document of Compliance or demonstrated for issuance of the Interim Document of Compliance; .3 the Company has planned the audit of the ship within three months; .4 the master and officers are familiar with the safety management system and the planned arrangements for its implementation; .5 instructions, which have been identified as being essential, are provided prior to sailing; and .6 relevant information on the safety management system has been given in a working language or languages understood by the ship’s personnel.

六項目は順に読めます。第一に、DOCまたは暫定DOCがその船に該当していなければなりません。会社側の証書が先にあって初めて船側の証書が出ます。第二に、その船に与えた安全管理システムがコードの主要な要素を含み、DOCの監査で評価されたか暫定DOCの発給時に実証されていなければなりません。

第三に、会社が3か月以内にその船の監査を計画していなければなりません。MSC.273(85)はこの項にinternalを入れ、その監査が会社の内部監査であることを明確にしました。第四に、船長と職員が安全管理システムとその実施の計画に慣れていなければなりません。第五に、不可欠と特定された指示が出航前に提供されていなければなりません。第六に、安全管理システムに関する情報が船員の理解する作業言語で与えられていなければなりません。

第四から第六までは船上で確認するものです。会社が変わる日に船長と職員が新しいシステムを知らなければ、暫定SMCの条件は満たされません。

事務所の審査が先で、船はその後です

主管庁側の手続きは、決議A.1118(30)の指針4.2にあります。

4.2.3 The process of interim verification for the issuance of an Interim Document of Compliance undertaken by the Administration would require an assessment at the company’s offices in accordance with paragraph 14.1 of the ISM Code.

4.2.4 On satisfactory completion of the assessment of the shoreside safety management system, arrangements/planning may commence for the assessment of applicable ships in the company’s fleet.

会社が主管庁に暫定認証を申請すると、主管庁は14.1に従って会社の事務所を先に評価します。陸上のシステムの評価が満足に終わって初めて、船隊の船に対する評価の準備が始まります。船の暫定検証は14.4に従って、その船に安全管理システムが備わっているかを見ます。

4.2.6 On satisfactory completion of the interim verification, an Interim Document of Compliance will be issued to the company; copies should be made available by the company to each shoreside premises and each applicable ship in the company’s fleet. As each ship is assessed and issued with an Interim Safety Management Certificate, a copy of the certificate should also be forwarded to the company’s head office.

暫定DOCが出ると、会社が写しを陸上の事業所ごとに、そして該当する船ごとに送ります。船が暫定SMCを受け取ると、その写しは逆に本社へ上がります。証書の写しが双方向に行き交う構造です。

暫定証書もDOCが取り消されれば一緒に消えます

13.5.1 All associated Safety Management Certificates and/or Interim Safety Management Certificates should also be withdrawn if the Document of Compliance is withdrawn.

13.5.1は正式なSMCと暫定SMCを区別しません。DOCが取り消されれば両方とも取り消されます。暫定SMCの様式も、DOCまたは暫定DOCが有効な間だけ証書が有効だと書きます。会社側の証書が暫定DOCであれば、その暫定DOCが満了した瞬間に暫定SMCも有効でなくなります。

二つの証書を並べるとこうなります。

この記事はMSC.104(73)が加えた14章の本文とMSC.273(85)による14.4.3の修正、そしてA.1118(30)の4.2までだけを扱います。14章は主管庁が暫定証書を発給できると書いた条項なので、実際に発給されるかどうかと手続きは旗国と認められた団体の要件に従います。その船の暫定SMCの満了日、3か月以内に組まれた内部監査の日付、そして会社側のDOCが正式か暫定かが、実際の判断の出発点です。
