최소안전배승 제안·승인·회수의 역할 분담과 문서에 담길 다섯 항목(IMO 결의 A.1047(27))

최소안전배승문서는 배가 바다로 나갈 때 최소한 몇 명을 어떤 직급으로 태워야 하는지를 적은 문서입니다. 이 문서는 주관청이 발급하지만, 그 안의 숫자를 처음 만드는 쪽은 배를 운항하는 회사입니다. IMO 총회 결의 A.1047(27)은 그 역할 분담을 적어 둔 문서입니다.

결의는 2011년에 채택됐고 앞선 결의 A.890(21)과 A.955(23)을 폐지했습니다. 결의 자체는 협약이 아니라 권고입니다. 그런데 항만국 통제는 이 문서의 준수를 안전배승의 증거로 봅니다. 문서에 적힌 인원보다 적게 태우고 나간 배는 그 증거를 스스로 버린 셈이 됩니다.

이 글은 결의의 본문과 부속서 1부터 5까지를 따라갑니다. 누가 무엇을 제안하고, 누가 무엇을 보고 승인하며, 문서에는 무엇이 적히고, 언제 다시 내야 하는지를 순서대로 봅니다.

결의는 권고이지만 항만국 통제는 문서를 증거로 봅니다

2. RECOMMENDS that Governments, in establishing the minimum safe manning levels for ships flying their country’s flag, observe the principles set out in Annex 1 and the procedures set out in Annex 5 and take into account the guidelines set out in Annexes 2 and 3;

4. URGES FURTHER Governments, when exercising port State control functions under international conventions in force with respect to foreign ships visiting their ports, to regard compliance with minimum safe manning documents as evidence that such ships are safely manned;

동사가 RECOMMENDS와 URGES입니다. 결의는 정부에 원칙을 지키라고 권고하고, 항만국 통제에서는 문서 준수를 증거로 보라고 촉구합니다. 문서를 발급할 의무 자체는 결의 전문이 언급하는 SOLAS 규칙 V/14에서 옵니다.

부속서의 역할이 각각 다릅니다. 부속서 1은 원칙, 부속서 2는 결정 요소, 부속서 3은 회사와 주관청의 책임, 부속서 4는 문서의 내용과 양식, 부속서 5는 결정 절차입니다. 아래 절은 이 순서대로 갑니다.

배승을 정할 때 열두 가지 요소를 봅니다

1.1 The minimum safe manning of a ship should be established taking into account all relevant factors, including the following: .1 size and type of ship; .2 number, size and type of main propulsion units and auxiliaries; .3 level of ship automation; .4 construction and equipment of the ship; .5 method of maintenance used; .6 cargo to be carried; .7 frequency of port calls, length and nature of voyages to be undertaken; .8 trading area(s), waters and operations in which the ship is involved; .9 extent to which training activities are conducted on board; .10 degree of shoreside support provided to the ship by the company; .11 applicable work hour limits and/or rest requirements; and .12 the provisions of the approved Ship’s Security Plan.

부속서 2의 목록입니다. 선박의 크기와 자동화 수준처럼 배 자체에 붙은 요소가 앞에 있고, 기항 빈도와 항로, 육상 지원의 정도처럼 운항 방식에 붙은 요소가 뒤에 있습니다. .11이 근로시간 한도와 휴식 요건입니다. 휴식시간은 배승이 정해진 뒤에 지키는 규칙이 아니라 배승을 정할 때 넣는 입력값입니다.

같은 부속서 1.3항은 제한된 크기의 배가 아니면 선장이 정규 당직을 서지 않도록 3직 체제를 갖출 항해사를 두라고 적습니다. 기관장에 대해서도 같은 문장이 있습니다. 1.4항은 최대 작업량이 걸리는 상황에 필요한 인원을 보라고 덧붙입니다.

제안서는 회사가 만들고 여섯 가지를 책임집니다

1.1 The Administration may require the company responsible for the operation of the ship to prepare and submit its proposal for the minimum safe manning of a ship in accordance with a form specified by the Administration.

부속서 3의 첫 문장입니다. 제안의 주체는 the company responsible for the operation of the ship입니다. 양식은 주관청이 정합니다.

회사가 제안을 준비하면서 해야 할 일은 1.2항에 여섯 가지로 적혀 있습니다. 직무 평가, 당직 적합성과 근로시간 기록의 시행, 인원과 직급의 평가, 제안서 제출, 상시 적정성 확보, 변경 시 새 제안입니다. 그중 제출 항목이 제안서의 내용을 정합니다.

.4 prepare and submit to the Administration a proposal for the minimum safe manning based upon the assessment of the numbers and grades/capacities in the ship’s complement required for its safe operation, for its security and for protection of the marine environment, justifying the proposal by explaining how the proposed ship’s complement will deal with emergency situations, including the evacuation of passengers, where necessary;

제안서는 인원수만 적는 서류가 아닙니다. justifying the proposal by explaining how the proposed ship's complement will deal with emergency situations가 붙어 있습니다. 그 인원으로 비상 상황을 어떻게 처리할지를 설명해야 합니다. 여객선이면 여객 피난까지 들어갑니다.

부속서 5는 이 설명을 만드는 방법을 단계로 풀어 둡니다. 운항 기능을 과업으로 쪼개고, 과업마다 소요 시간·빈도·필요 역량·중요도를 적고, 한 사람이 한 근무 시간 안에 처리할 수 있는 과업 수를 따진 뒤, 그 작업량이 휴식시간 규정을 넘지 않는지 확인합니다.

주관청은 두 가지를 확인한 뒤에만 승인합니다

2.1 A proposal for the minimum safe manning of a ship submitted by a company to the Administration should be evaluated by the Administration to ensure that: .1 the proposed ship’s complement contains the number and grades/capacities of personnel to fulfil the tasks, duties and responsibilities required for the safe operation of the ship, for its security, for protection of the marine environment and for dealing with emergency situations; and .2 the master, officers and other members of the ship’s complement are not required to work more hours than is safe in relation to the performance of their duties and the safety of the ship and that the requirements for work and rest hours, in accordance with applicable national regulations, can be complied with.

평가 기준이 둘입니다. 첫째는 과업을 다 수행할 수 있는 인원과 직급인가입니다. 둘째는 그 인원으로 근로·휴식시간 요건을 지킬 수 있는가입니다. 두 조건이 and로 묶여 있습니다. 과업은 다 처리되는데 휴식이 깨지는 제안은 둘째 기준에서 걸립니다.

주관청이 제안을 승인할 수 없으면 2.3항에 따라 수정을 요구합니다. 2.4항은 결의의 원칙에 맞고 모든 면에서 적정하다고 확신할 때에만 승인하고 문서를 발급하라고 적습니다. 승인 뒤에도 문서는 고정되지 않습니다.

2.5 The Administration may withdraw the minimum safe manning document of a ship if the company fails to submit a new proposal for the ship’s minimum safe manning when changes in trading area(s), construction, machinery, equipment or operation and maintenance of the ship have taken place which affect the minimum safe manning.

2.6 The Administration should review and may withdraw, as appropriate, the minimum safe manning document of a ship which persistently fails to be in compliance with rest hours requirements.

회수 사유가 둘입니다. 하나는 변경이 생겼는데 새 제안을 내지 않은 경우입니다. 다른 하나는 휴식시간 요건을 계속 어기는 경우입니다. 휴식시간 기록은 선원 개인의 서류이면서 동시에 그 배의 배승문서가 유지될 근거가 됩니다.

2.7 The Administration should consider the circumstances very carefully before allowing a minimum safe manning document to contain provisions for less than three qualified officers in charge of a navigational watch, while taking into account all the principles for establishing safe manning.

항해당직 사관을 셋 미만으로 적는 문서에는 별도의 신중한 검토가 붙습니다. 부속서 2의 3직 체제 문장과 같은 방향입니다.

문서에는 다섯 항목이 들어가고 영어 번역이 붙습니다

부속서 4는 문서에 최소한 담길 정보를 다섯으로 적습니다. 선박 특정 정보, 인원과 직급의 표, 주관청의 공식 선언, 유효성의 제한, 발급일·만료일과 서명·인장입니다. 그중 셋째 항목이 문서의 효력을 정하는 문장입니다.

.3 a formal statement by the Administration that, in accordance with the principles and guidelines set out in Annexes 1 and 2, the ship named in the document is considered to be safely manned if, whenever it proceeds to sea, it carries not less than the number and grades/capacities of personnel shown in the document, subject to any special conditions stated therein;

조건이 whenever it proceeds to sea입니다. 출항할 때마다 표에 적힌 인원과 직급 이상을 태워야 합니다. 한 번 채웠다고 끝나는 조건이 아니라 매 출항에 다시 걸리는 조건입니다. subject to any special conditions에 따라 문서에 적힌 특별 조건도 같이 봅니다.

부록의 모델 양식은 인원 표를 세 열로 둡니다. 직급, 그 직급에 해당하는 STCW 규칙, 인원수입니다. 문서의 언어가 영어가 아니면 영어 번역을 포함합니다. 항만국 통제관이 읽는 문서라서 그렇습니다.

변경이 생기면 회사가 새 제안을 냅니다

.6 prepare and submit to the Administration a new proposal for the minimum safe manning of a ship in the case of changes in trading area(s), construction, machinery, equipment, operation and maintenance or management of the ship, which may affect the safe manning.

부속서 3 1.2항의 마지막 항목입니다. 항행 구역, 구조, 기관, 설비, 운항·정비 방식, 관리 주체가 바뀌면 새 제안을 냅니다. 조건은 which may affect the safe manning입니다. 배승에 영향을 줄 수 있는 변경이면 됩니다. 부속서 5의 3절도 회사가 그런 변경을 주관청에 알리고 새 제안을 내라고 적습니다.

앞서 본 2.5항이 이 의무의 뒷면입니다. 변경이 있었는데 새 제안이 없으면 주관청이 문서를 회수할 수 있습니다. 부속서 5의 4절은 주관청이 배승 체계를 주기적으로 검토하라고 덧붙입니다. 회사 쪽에서는 선박의 관리 회사가 바뀌거나 항행 구역이 넓어진 시점이 곧 새 제안의 시점입니다.
