오수 배출 조건과 국제오수오염방지증서의 검사·유효기간(MARPOL 부속서 IV 규칙 2·4·8·11)

MARPOL 부속서 IV는 두 축으로 읽습니다. 하나는 증서입니다. 어느 배가 국제오수오염방지증서(ISPP)를 받아야 하고, 검사는 어떤 종류이며, 유효기간은 어떻게 세는가입니다. 다른 하나는 배출입니다. 오수를 바다에 내보낼 수 있는 거리와 속도, 설비 조건입니다.

본문은 2005년 8월 1일 발효한 결의 MEPC.115(51)의 개정 부속서 IV입니다. 배출 조건인 규칙 11은 2013년 1월 1일 발효한 MEPC.200(62)가 통째로 바꿨습니다. 이 글은 바뀐 뒤의 규칙 11로 읽습니다.

같은 결의가 발트해를 특별해역으로 지정했습니다. 그 조항은 특별해역 안의 여객선에만 걸리는 것이지 전 세계 공통 의무가 아닙니다. 그 밖의 배는 어느 바다에서든 규칙 11.1을 따릅니다.

적용은 국제항해 선박이고 문턱은 400총톤 또는 15명 초과입니다

1 The provisions of this Annex shall apply to the following ships engaged in international voyages: .1 new ships of 400 gross tonnage and above; and .2 new ships of less than 400 gross tonnage which are certified to carry more than 15 persons; and .3 existing ships of 400 gross tonnage and above, five years after the date of entry into force of this Annex; and .4 existing ships of less than 400 gross tonnage which are certified to carry more than 15 persons, five years after the date of entry into force of this Annex.

조건이 앞에 하나 있습니다. 국제항해에 종사하는 배입니다. 규칙 1.6은 국제항해를 협약 적용국에서 그 밖의 항만으로 가는 항해로 정합니다. 그 다음이 400총톤이거나 15명 초과 정원입니다. 부속서 V의 관리계획이 15 or more인 것과 달리 여기는 more than 15입니다. 정원 15명인 배는 부속서 V의 관리계획에는 걸리고 부속서 IV에는 걸리지 않습니다.

규칙 1.7의 Person은 선원과 여객을 합친 수입니다. 기존선의 5년 유예는 2005년 발효일 기준이므로 이미 지났습니다.

증서는 초기·갱신·추가 검사 세 종류 위에 섭니다

.1 An initial survey before the ship is put in service or before the Certificate required under regulation 5 of this Annex is issued for the first time, which shall include a complete survey of its structure, equipment, systems, fittings, arrangements and material in so far as the ship is covered by this Annex. This survey shall be such as to ensure that the structure, equipment, systems, fittings, arrangements and material fully comply with the applicable requirements of this Annex. .2 A renewal survey at intervals specified by the Administration, but not exceeding five years, except where regulation 8.2, 8.5, 8.6 or 8.7 of this Annex is applicable. The renewal survey shall be such as to ensure that the structure, equipment, systems, fittings, arrangements and material fully comply with applicable requirements of this Annex. .3 An additional survey either general or partial, according to the circumstances, shall be made after a repair resulting from investigations prescribed in paragraph 4 of this regulation, or whenever any important repairs or renewals are made. The survey shall be such as to ensure that the necessary repairs or renewals have been effectively made, that the material and workmanship of such repairs or renewals are in all respects satisfactory and that the ship complies in all respects with the requirements of this Annex.

부속서 VI의 IAPP 증서와 달리 연차검사와 중간검사가 없습니다. 검사는 셋뿐입니다. 취항 전 또는 첫 증서 발급 전의 초기검사, 주관청이 정한 간격의 갱신검사, 그리고 수리나 교체 뒤의 추가검사입니다. 갱신 간격의 상한은 5년입니다.

검사는 주관청 관리가 하되, 지정 검사원이나 인정 단체에 맡길 수 있습니다(규칙 4.3). 검사가 끝난 뒤에는 주관청 승인 없이 검사 대상 구조나 설비를 바꿀 수 없고, 동일품 직접 교체만 예외입니다(규칙 4.8). 사고나 결함이 생기면 선장이나 선주가 증서 발급 책임자에게 바로 보고합니다(규칙 4.9).

유효기간은 5년이 상한이고 갱신검사 시점이 기산일을 정합니다

1 An International Sewage Pollution Prevention Certificate shall be issued for a period specified by the Administration which shall not exceed five years. 2.1 Notwithstanding the requirements of paragraph 1 of this regulation, when the renewal survey is completed within three months before the expiry date of the existing Certificate, the new Certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of expiry of the existing Certificate. .2 When the renewal survey is completed after the expiry date of the existing Certificate, the new Certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of expiry of the existing Certificate. .3 When the renewal survey is completed more than three months before the expiry date of the existing Certificate, the new Certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of completion of the renewal survey.

세 경우의 차이는 새 증서의 5년을 어디서부터 세느냐입니다. 만료 전 3개월 안에 갱신검사를 마치면 기존 만료일부터 5년입니다. 만료 뒤에 마쳐도 기존 만료일부터 5년입니다. 만료 3개월보다 일찍 마치면 검사 완료일부터 5년이라, 그만큼 기간을 잃습니다.

연장은 세 갈래입니다. 갱신검사는 마쳤는데 새 증서를 선내에 둘 수 없으면, 기존 증서에 배서해 만료일부터 최대 5개월까지 인정합니다(8.4). 검사받을 항만에 없으면 그 항만까지 가는 목적으로만 최대 3개월 연장할 수 있고, 도착 뒤에는 새 증서 없이 떠날 수 없습니다(8.5). 단기 항해 선박은 최대 1개월의 유예가 있습니다(8.6). 어느 경우든 새 증서의 5년은 연장 전의 만료일부터 셉니다.

8 A Certificate issued under regulation 5 or 6 of this Annex shall cease to be valid in either of the following cases: .1 if the relevant surveys are not completed within the periods specified under regulation 4.1 of this Annex; or .2 upon transfer of the ship to the flag of another State. A new Certificate shall only be issued when the Government issuing the new Certificate is fully satisfied that the ship is in compliance with the requirements of regulations 4.7 and 4.8 of this Annex. In the case of a transfer between Parties, if requested within 3 months after the transfer has taken place, the Government of the Party whose flag the ship was formerly entitled to fly shall, as soon as possible, transmit to the Administration copies of the Certificate carried by the ship before the transfer and, if available, copies of the relevant survey reports.

효력 상실 사유는 둘입니다. 검사를 기간 안에 마치지 못한 경우와 기국이 바뀐 경우입니다. 기국 이전 뒤의 새 증서는 새 기국이 규칙 4.7과 4.8의 충족을 확인한 뒤에만 발급합니다. 이전 기국은 요청이 있으면 옛 증서와 검사 보고서 사본을 보냅니다.

설비는 처리장치·분쇄소독장치·저장탱크 중 하나입니다

1 Every ship which, in accordance with regulation 2, is required to comply with the provisions of this Annex shall be equipped with one of the following sewage systems: .1 a sewage treatment plant which shall be of a type approved by the Administration, taking into account the standards and test methods developed by the Organization, or .2 a sewage comminuting and disinfecting system approved by the Administration. Such system shall be fitted with facilities to the satisfaction of the Administration, for the temporary storage of sewage when the ship is less than 3 nautical miles from the nearest land, or .3 a holding tank of the capacity to the satisfaction of the Administration for the retention of all sewage, having regard to the operation of the ship, the number of persons on board and other relevant factors. The holding tank shall be constructed to the satisfaction of the Administration and shall have a means to indicate visually the amount of its contents.

어느 설비를 갖췄는지가 아래 배출 조건의 어느 줄을 쓸 수 있는지를 정합니다. 분쇄소독장치는 3해리 안에서 쓸 임시 저장설비가 함께 있어야 승인됩니다. 저장탱크는 용량이 운항 형태와 승선 인원에 맞아야 하고, 내용량을 눈으로 확인할 수단이 있어야 합니다. 규칙 10은 수용시설 배관과 잇는 표준 배출 연결구의 플랜지 치수를 정합니다.

배출 조건은 MEPC.200(62)가 다시 쓴 규칙 11이 정합니다

1 Subject to the provisions of regulation 3 of this Annex, the discharge of sewage into the sea is prohibited, except when: .1 the ship is discharging comminuted and disinfected sewage using a system approved by the Administration in accordance with regulation 9.1.2 of this Annex at a distance of more than 3 nautical miles from the nearest land, or sewage which is not comminuted or disinfected at a distance of more than 12 nautical miles from the nearest land, provided that, in any case, the sewage that has been stored in holding tanks, or sewage originating from spaces containing living animals, shall not be discharged instantaneously but at a moderate rate when the ship is en route and proceeding at not less than 4 knots; the rate of discharge shall be approved by the Administration based upon standards developed by the Organization; or .2 the ship has in operation an approved sewage treatment plant which has been certified by the Administration to meet the operational requirements referred to in regulation 9.1.1 of this Annex, and the effluent shall not produce visible floating solids nor cause discoloration of the surrounding water.

세 길이 있습니다. 분쇄소독한 오수는 3해리 밖, 처리하지 않은 오수는 12해리 밖입니다. 둘 다 저장탱크에 모아 둔 오수나 동물 사육 구역의 오수라면 한꺼번에 내보내지 못합니다. 항행 중 4노트 이상에서 주관청이 승인한 속도로 내보냅니다. 승인된 처리장치가 가동 중이면 거리 조건 없이 배출할 수 있되, 부유 고형물이 보이거나 주변 물이 변색되면 안 됩니다.

2005년 본문과 비교하면 두 곳이 달라졌습니다. 동물 사육 구역의 오수가 저장탱크 오수와 같은 유량 조건에 들어왔습니다. 처리장치 쪽에서는 시험 결과를 증서에 적어 둘 것이라는 하위 항이 빠지고 유출수 조건만 남았습니다. 규칙 11.2는 연안국이 자국 관할수역에 더 느슨한 기준을 두면 그 수역에서는 그 기준을 따를 수 있게 합니다.

특별해역에서는 여객선만 다른 줄을 탑니다

3 Subject to the provisions of regulation 3 of this Annex, the discharge of sewage from a passenger ship within a special area shall be prohibited: a) for new passenger ships on, or after 1 January 2016, subject to paragraph 2 of regulation 12bis; and b) for existing passenger ships on, or after 1 January 2018, subject to paragraph 2 of regulation 12bis, except when the following conditions are satisfied: the ship has in operation an approved sewage treatment plant which has been certified by the Administration to meet the operational requirements referred to in regulation 9.2.1 of this Annex, and the effluent shall not produce visible floating solids nor cause discoloration of the surrounding water.

MEPC.200(62)는 규칙 1에 특별해역 정의(5bis)를 넣고 발트해를 첫 특별해역으로 정했습니다. 여객선은 12명을 넘는 여객을 태우는 배입니다(7ter). 특별해역 안의 여객선은 규칙 9.2.1의 처리장치를 가동하지 않으면 오수를 배출할 수 없습니다. 분쇄소독이나 12해리 밖 배출의 길이 닫힙니다.

조문의 두 날짜에는 subject to paragraph 2 of regulation 12bis가 붙어 있습니다.

2 The Government of each Party concerned shall notify the Organization of the measures taken pursuant to paragraph 1 of this regulation. Upon receipt of sufficient notifications in accordance with paragraph 1 of this regulation, the Organization shall establish a date from which the requirements of regulation 11.3 in respect of the area in question shall take effect. The Organization shall notify all Parties of the date so established no less than 12 months in advance of that date. Until the date so established, ships while navigating in the special area shall comply with the requirements of regulation 11.1 of this Annex.

즉 규칙 11.3의 실제 효력일은 연안 당사국의 수용시설 통지를 받아 기구가 따로 정합니다. 그날까지는 특별해역 안에서도 규칙 11.1을 따릅니다. 이 글은 결의 MEPC.200(62) 본문까지만 다룹니다. 발트해에 실제로 정해진 날짜는 그 뒤의 결의에서 확인해야 합니다.

확인해 둘 것

규칙 3의 예외(안전 확보, 손상으로 인한 배출)는 규칙 11에만 걸리고 증서 요건과는 무관합니다. 규칙 11.4는 오수가 다른 부속서의 폐기물과 섞이면 그 부속서의 요건도 함께 지키라고 정합니다. MEPC.200(62)는 증서 양식에도 선박 종류와 처리장치의 인증 기준을 적는 칸을 더했습니다. 처리장치의 유출수 기준 자체는 기구의 별도 결의가 정하므로 이 글의 범위 밖입니다.
