汚水の排出条件と国際汚水汚染防止証書の検査・有効期間（MARPOL附属書IV規則2・4・8・11）

MARPOL附属書IVは二つの軸で読みます。一つは証書です。どの船が国際汚水汚染防止証書（ISPP）を受けなければならず、検査はどの種類で、有効期間はどう数えるかです。もう一つは排出です。汚水を海へ出せる距離と速力、設備の条件です。

本文は2005年8月1日に発効した決議MEPC.115(51)の改正附属書IVです。排出条件である規則11は、2013年1月1日に発効したMEPC.200(62)が丸ごと置き換えました。この記事は置き換え後の規則11で読みます。

同じ決議がバルト海を特別海域に指定しました。その条項は特別海域内の旅客船にだけ掛かるもので、世界共通の義務ではありません。それ以外の船はどの海でも規則11.1に従います。

適用は国際航海に従事する船で、敷居は400総トン又は15人超です

1 The provisions of this Annex shall apply to the following ships engaged in international voyages: .1 new ships of 400 gross tonnage and above; and .2 new ships of less than 400 gross tonnage which are certified to carry more than 15 persons; and .3 existing ships of 400 gross tonnage and above, five years after the date of entry into force of this Annex; and .4 existing ships of less than 400 gross tonnage which are certified to carry more than 15 persons, five years after the date of entry into force of this Annex.

条件が先に一つあります。国際航海に従事する船であることです。規則1.6は国際航海を、条約の適用国からその外の港へ向かう航海と定めます。その次が400総トン、又は15人を超える定員です。附属書Vの管理計画が15 or moreであるのと違い、ここはmore than 15です。定員15人の船は附属書Vの管理計画には掛かり、附属書IVには掛かりません。

規則1.7のPersonは船員と旅客を合わせた数です。現存船の5年の猶予は2005年の発効日が基準なので、すでに過ぎています。

証書は初回・更新・追加の三種類の検査の上に立ちます

.1 An initial survey before the ship is put in service or before the Certificate required under regulation 5 of this Annex is issued for the first time, which shall include a complete survey of its structure, equipment, systems, fittings, arrangements and material in so far as the ship is covered by this Annex. This survey shall be such as to ensure that the structure, equipment, systems, fittings, arrangements and material fully comply with the applicable requirements of this Annex. .2 A renewal survey at intervals specified by the Administration, but not exceeding five years, except where regulation 8.2, 8.5, 8.6 or 8.7 of this Annex is applicable. The renewal survey shall be such as to ensure that the structure, equipment, systems, fittings, arrangements and material fully comply with applicable requirements of this Annex. .3 An additional survey either general or partial, according to the circumstances, shall be made after a repair resulting from investigations prescribed in paragraph 4 of this regulation, or whenever any important repairs or renewals are made. The survey shall be such as to ensure that the necessary repairs or renewals have been effectively made, that the material and workmanship of such repairs or renewals are in all respects satisfactory and that the ship complies in all respects with the requirements of this Annex.

附属書VIのIAPP証書と違い、年次検査と中間検査がありません。検査は三つだけです。就航前又は最初の証書発給前の初回検査、主管庁が定めた間隔の更新検査、そして修理や取替えの後の追加検査です。更新間隔の上限は5年です。

検査は主管庁の職員が行いますが、指名した検査員や認定団体に委ねることができます（規則4.3）。検査が終わった後は、主管庁の承認なしに検査対象の構造や設備を変えられず、同一品の直接取替えだけが例外です（規則4.8）。事故や欠陥が生じれば、船長又は船舶所有者が証書発給の責任者に直ちに報告します（規則4.9）。

有効期間は5年が上限で、更新検査の時期が起算日を決めます

1 An International Sewage Pollution Prevention Certificate shall be issued for a period specified by the Administration which shall not exceed five years. 2.1 Notwithstanding the requirements of paragraph 1 of this regulation, when the renewal survey is completed within three months before the expiry date of the existing Certificate, the new Certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of expiry of the existing Certificate. .2 When the renewal survey is completed after the expiry date of the existing Certificate, the new Certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of expiry of the existing Certificate. .3 When the renewal survey is completed more than three months before the expiry date of the existing Certificate, the new Certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of completion of the renewal survey.

三つの場合の違いは、新しい証書の5年をどこから数えるかです。満了前3か月以内に更新検査を終えれば、従来の満了日から5年です。満了後に終えても従来の満了日から5年です。満了の3か月より前に終えると検査完了日から5年なので、その分の期間を失います。

延長は三通りです。更新検査は終えたのに新しい証書を船内に置けないときは、従来の証書に裏書して満了日から最長5か月まで認めます（8.4）。検査を受ける港にいないときは、その港へ向かう目的に限って最長3か月延長でき、到着後は新しい証書なしに出港できません（8.5）。短い航海に従事する船には最長1か月の猶予があります（8.6）。いずれの場合も、新しい証書の5年は延長前の満了日から数えます。

8 A Certificate issued under regulation 5 or 6 of this Annex shall cease to be valid in either of the following cases: .1 if the relevant surveys are not completed within the periods specified under regulation 4.1 of this Annex; or .2 upon transfer of the ship to the flag of another State. A new Certificate shall only be issued when the Government issuing the new Certificate is fully satisfied that the ship is in compliance with the requirements of regulations 4.7 and 4.8 of this Annex. In the case of a transfer between Parties, if requested within 3 months after the transfer has taken place, the Government of the Party whose flag the ship was formerly entitled to fly shall, as soon as possible, transmit to the Administration copies of the Certificate carried by the ship before the transfer and, if available, copies of the relevant survey reports.

効力を失う事由は二つです。検査を期間内に終えなかった場合と、旗国が変わった場合です。旗国移転後の新しい証書は、新しい旗国が規則4.7と4.8の充足を確かめた後にだけ発給します。前の旗国は、求めがあれば旧証書と検査報告書の写しを送ります。

設備は処理装置・粉砕消毒装置・保持タンクのいずれかです

1 Every ship which, in accordance with regulation 2, is required to comply with the provisions of this Annex shall be equipped with one of the following sewage systems: .1 a sewage treatment plant which shall be of a type approved by the Administration, taking into account the standards and test methods developed by the Organization, or .2 a sewage comminuting and disinfecting system approved by the Administration. Such system shall be fitted with facilities to the satisfaction of the Administration, for the temporary storage of sewage when the ship is less than 3 nautical miles from the nearest land, or .3 a holding tank of the capacity to the satisfaction of the Administration for the retention of all sewage, having regard to the operation of the ship, the number of persons on board and other relevant factors. The holding tank shall be constructed to the satisfaction of the Administration and shall have a means to indicate visually the amount of its contents.

どの設備を備えたかが、以下の排出条件のどの行を使えるかを決めます。粉砕消毒装置は、3海里以内で使う一時貯留設備が一緒にあってはじめて承認されます。保持タンクは容量が運航形態と乗船人数に見合っていなければならず、内容量を目で確かめる手段が要ります。規則10は受入施設の配管とつなぐ標準排出接続具のフランジ寸法を定めます。

排出条件はMEPC.200(62)が書き直した規則11が定めます

1 Subject to the provisions of regulation 3 of this Annex, the discharge of sewage into the sea is prohibited, except when: .1 the ship is discharging comminuted and disinfected sewage using a system approved by the Administration in accordance with regulation 9.1.2 of this Annex at a distance of more than 3 nautical miles from the nearest land, or sewage which is not comminuted or disinfected at a distance of more than 12 nautical miles from the nearest land, provided that, in any case, the sewage that has been stored in holding tanks, or sewage originating from spaces containing living animals, shall not be discharged instantaneously but at a moderate rate when the ship is en route and proceeding at not less than 4 knots; the rate of discharge shall be approved by the Administration based upon standards developed by the Organization; or .2 the ship has in operation an approved sewage treatment plant which has been certified by the Administration to meet the operational requirements referred to in regulation 9.1.1 of this Annex, and the effluent shall not produce visible floating solids nor cause discoloration of the surrounding water.

道は三つです。粉砕し消毒した汚水は3海里の外、処理していない汚水は12海里の外です。どちらも、保持タンクにためた汚水や動物を飼う区画からの汚水なら一度に出せません。航行中に4ノット以上で、主管庁が承認した速度で出します。承認された処理装置が運転中なら距離の条件なしに排出できますが、浮遊固形物が見えたり周囲の水が変色したりしてはなりません。

2005年の本文と比べると二か所が変わりました。動物を飼う区画からの汚水が、保持タンクの汚水と同じ流量の条件に入りました。処理装置の側では、試験結果を証書に記載しておくという下位の号が外れ、排出水の条件だけが残りました。規則11.2は、沿岸国が自国の管轄水域により緩い基準を置いていれば、その水域ではその基準に従えるようにしています。

特別海域では旅客船だけが別の行に乗ります

3 Subject to the provisions of regulation 3 of this Annex, the discharge of sewage from a passenger ship within a special area shall be prohibited: a) for new passenger ships on, or after 1 January 2016, subject to paragraph 2 of regulation 12bis; and b) for existing passenger ships on, or after 1 January 2018, subject to paragraph 2 of regulation 12bis, except when the following conditions are satisfied: the ship has in operation an approved sewage treatment plant which has been certified by the Administration to meet the operational requirements referred to in regulation 9.2.1 of this Annex, and the effluent shall not produce visible floating solids nor cause discoloration of the surrounding water.

MEPC.200(62)は規則1に特別海域の定義（5bis）を入れ、バルト海を最初の特別海域と定めました。旅客船は12人を超える旅客を乗せる船です（7ter）。特別海域内の旅客船は、規則9.2.1の処理装置を運転していなければ汚水を排出できません。粉砕消毒や12海里の外での排出という道は閉じます。

条文の二つの日付にはsubject to paragraph 2 of regulation 12bisが付いています。

2 The Government of each Party concerned shall notify the Organization of the measures taken pursuant to paragraph 1 of this regulation. Upon receipt of sufficient notifications in accordance with paragraph 1 of this regulation, the Organization shall establish a date from which the requirements of regulation 11.3 in respect of the area in question shall take effect. The Organization shall notify all Parties of the date so established no less than 12 months in advance of that date. Until the date so established, ships while navigating in the special area shall comply with the requirements of regulation 11.1 of this Annex.

つまり規則11.3の実際の効力発生日は、沿岸締約国の受入施設の通報を受けて機関が別に定めます。その日までは特別海域内でも規則11.1に従います。この記事は決議MEPC.200(62)の本文までを扱います。バルト海に実際に定められた日付は、その後の決議で確認する必要があります。

確認しておくこと

規則3の例外（安全の確保、損傷による排出）は規則11にだけ掛かり、証書の要件とは無関係です。規則11.4は、汚水が他の附属書の廃棄物と混ざれば、その附属書の要件も併せて守るよう定めます。MEPC.200(62)は証書の様式にも、船の種類と処理装置の認証基準を書く欄を加えました。処理装置の排出水基準そのものは機関の別の決議が定めるので、この記事の範囲外です。
