廃棄物の海洋への排出条件と特別海域の違い（MARPOL附属書V規則3・4・6）

MARPOL附属書Vは廃棄物を海に捨てる行為を原則として禁止し、規則4と規則6で種類ごとに例外を開きます。規則4は特別海域の外、規則6は特別海域の内です。同じ食物くずでも、どの海にいるかで距離と処理の条件が変わります。

特別海域は規則1.14が八か所を定めます。地中海、バルト海、黒海、紅海、湾岸海域、北海、南極海域、広域カリブ海です。特別海域の条件は世界共通の義務ではなく、その海域の中でだけ掛かるので、航路が特別海域に入るかどうかをまず確かめる必要があります。規則8.2.2により、各海域の規則6は沿岸締約国の受入施設の通報を受けて機関が定めた日から効力を持ちます。

本文は2013年1月1日に発効した決議MEPC.201(62)です。2018年3月1日に発効したMEPC.277(70)が、貨物残渣の有害性の判定基準を附録Iに移し、荷送人の申告を入れました。以下は改正後の条文です。

出発点は全面禁止で、プラスチックと食用油には例外がありません

1 Discharge of all garbage into the sea is prohibited, except as provided otherwise in regulations 4, 5, 6 and 7 of this Annex. 2 Except as provided in regulation 7 of this Annex, discharge into the sea of all plastics, including but not limited to synthetic ropes, synthetic fishing nets, plastic garbage bags and incinerator ashes from plastic products is prohibited. 3 Except as provided in regulation 7 of this Annex, the discharge into the sea of cooking oil is prohibited.

規則3の構造が、以下のすべての条件を読む枠です。第1項はすべての廃棄物の排出を禁止し、規則4・5・6・7だけが例外を開きます。第2項と第3項はプラスチックと食用油を別に書き、規則4と6の例外からも外します。残る例外は規則7の安全・事故の例外だけです。

プラスチックの範囲は規則1.13が定めます。合成ロープ、合成漁網、プラスチック製ごみ袋、プラスチック製品を焼いた焼却灰までall plasticsに入ります。焼却灰は区分Eですが、プラスチックを焼いた灰なら排出できません。

特別海域の外では食物くずが3海里と12海里で分かれます

1 Discharge of the following garbage into the sea outside special areas shall only be permitted while the ship is en route and as far as practicable from the nearest land, but in any case not less than: .1 3 nautical miles from the nearest land for food wastes which have been passed through a comminuter or grinder. Such comminuted or ground food wastes shall be capable of passing through a screen with openings no greater than 25 mm. .2 12 nautical miles from the nearest land for food wastes that have not been treated in accordance with subparagraph .1 above. .3 12 nautical miles from the nearest land for cargo residues that cannot be recovered using commonly available methods for unloading. These cargo residues shall not contain any substances classified as harmful to the marine environment, taking into account guidelines developed by the Organization. .4 For animal carcasses, discharge shall occur as far from the nearest land as possible, taking into account the guidelines developed by the Organization.

すべての項目に共通する条件が二つあります。船がen routeであること、そして最も近い陸地から実行可能な限り離れていることです。規則1.5のen routeは、単に動いている状態ではありません。排出物が合理的で実行可能な限り広い海域に広がるように航行中である状態です。錨泊中や漂流中の排出はこの条件を満たしません。

食物くずは処理の有無が距離を決めます。粉砕機を通して25mmのふるいを通る状態なら3海里、そうでなければ12海里です。貨物残渣は12海里に加えて有害物質を含まないことが要ります。MEPC.277(70)は.3の第二文を改めました。指針を考慮せよというtaking into account guidelines developed by the Organizationが外れました。代わりにin accordance with the criteria set out in appendix Iが入りました。判定基準が勧告的な指針から附属書本文の附録へ上がったのです。

同じ決議が規則4に新しい第3項を入れ、従来の第3項を第4項へ繰り下げました。

3 Solid bulk cargoes as defined in regulation VI/1-1.2 of the International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended, other than grain, shall be classified in accordance with appendix I of this Annex, and declared by the shipper as to whether or not they are harmful to the marine environment.

穀物を除く固体ばら積み貨物は、荷送人が附録Iに従って分類し、有害かどうかを申告します。船はその申告を受けて貨物残渣を区分J（non-HME）とK（HME）に分けて記載します。申告がなければ、船が残渣を海に捨てる根拠がありません。

特別海域の内では食物くず12海里に粉砕が付き、貨物残渣は六つの条件をすべて満たさなければなりません

1 Discharge of the following garbage into the sea within special areas shall only be permitted while the ship is en route and as follows: .1 Discharge into the sea of food wastes as far as practicable from the nearest land, but not less than 12 nautical miles from the nearest land or the nearest ice shelf. Food wastes shall be comminuted or ground and shall be capable of passing through a screen with openings no greater than 25 mm. Food wastes shall not be contaminated by any other garbage type. Discharge of introduced avian products, including poultry and poultry parts, is not permitted in the Antarctic area unless it has been treated to be made sterile.

外では粉砕すれば3海里だった食物くずが、内では粉砕しても12海里です。粉砕していない食物くずは特別海域では排出できません。距離の基準にthe nearest ice shelfが加わり、他の廃棄物に汚染されていないという条件が付きます。南極海域では家きん製品を滅菌しなければ排出できません。

貨物残渣は規則6.1.2の条件をすべて満たさなければなりません。MEPC.277(70)が条件三つを新しく書き、従来の三つを後ろへ繰り下げて六つになりました。新しく書いた条件は次のとおりです。

.1 Cargo residues contained in hold washing water do not include any substances classified as harmful to the marine environment according to the criteria set out in appendix I of this Annex; .2 Solid bulk cargoes as defined in regulation VI/1-1.2 of the International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended, other than grain, shall be classified in accordance with appendix I of this Annex, and declared by the shipper as to whether or not they are harmful to the marine environment; .3 Cleaning agents or additives contained in hold washing water do not include any substances classified as harmful to the marine environment taking into account guidelines developed by the Organization;

繰り下げられた三つは2013年発効の本文の条件です。出発港と次の仕向港がともに特別海域内にあり、その間に海域の外へ出ないこと（.4）、それらの港に適切な受入施設がないこと（.5）、そして距離の条件（.6）です。距離の条件は次のように書き改められました。

.6 Where the conditions of subparagraphs .2.1 to .2.5 of this paragraph have been fulfilled, discharge of cargo hold washing water containing residues shall be made as far as practicable from the nearest land or the nearest ice shelf and not less than 12 nautical miles from the nearest land or the nearest ice shelf.

六つの条件はすべて満たさなければなりません。受入施設のある港へ向かう船は五つ目の条件で止まります。特別海域内での貨物残渣の排出は、受入施設がないときの代替であって、通常の処理経路ではありません。

混ざればより厳しい側に従います

3 When garbage is mixed with or contaminated by other substances prohibited from discharge or having different discharge requirements, the more stringent requirements shall apply.

2013年発効の本文の規則4第3項で、MEPC.277(70)が第4項に番号を変えました。規則6.4に同じ文があります。食物くずにビニール袋が混ざれば、食物くずではなくプラスチックの規則に従います。つまり排出が止まります。分別保管が排出条件の前提になる理由です。

例外は規則7が閉じています

規則7.1は四つの状況に規則3・4・5・6を適用しません。船と人命の安全のための排出、損傷による事故の流失、合理的な予防措置を取っても失った漁具、海洋環境の保護や船の安全のための漁具の投棄です。そしてen routeの条件に例外が一つあります。

.1 The en route requirements of regulations 4 and 6 shall not apply to the discharge of food wastes where it is clear the retention on board of these food wastes presents an imminent health risk to the people on board.

保管が乗船者の健康に差し迫った危険となるとき、食物くずに限って航行中の条件を解きます。距離の条件まで解くわけではありません。こうした例外的な排出は、規則10.3.6により記録簿に理由とともに書きます。

確認しておくこと

この記事はMEPC.201(62)の規則3・4・6・7と、MEPC.277(70)が変えた部分までを扱います。極海コードの廃棄物規定とその後の改正は扱いません。附録Iの有害性の判定基準は国連GHS分類に従うので、荷送人の申告書の分類根拠をその基準に照らす必要があります。規則6.3は南極海域について、入る前にすべての廃棄物を保持する容量と、出た後に受入施設へ引き渡す取決めを追加で求めます。
