電子記録簿が紙の記録簿と違う三つの点と主管庁の宣言書（MEPC.314(74)・MEPC.312(74)）

MARPOLの記録簿は長く紙でした。2019年5月17日に採択され2020年10月1日に発効した決議MEPC.314(74)が、附属書I・II・Vに電子記録簿の定義を入れました。油記録簿、貨物記録簿、廃棄物記録簿を電子で備えられるようになったのです。同じ日に採択されたMEPC.312(74)は、主管庁が電子記録簿を承認するときに見る指針です。

紙の記録簿をPDFや表計算に移しただけでは電子記録簿になりません。条文が求めるのは主管庁の承認で、指針はその承認の基準です。この記事は電子記録簿が紙と違う三つの点を指針の本文で読みます。記載の保存条件、署名の代替、バックアップと写しです。そして検査のときに何を見せなければならないかで締めます。

電子記録簿は主管庁が承認した装置であってはじめて記録簿になります

39 Electronic Record Book means a device or system, approved by the Administration, used to electronically record the required entries for discharges, transfers and other operations as required under this Annex in lieu of a hard copy record book.

MEPC.314(74)が附属書I規則1に入れた定義です。附属書II規則1（第22項）と附属書V規則1（第19項）にも同じ文が入りました。要はapproved by the Administrationとin lieu of a hard copy record bookです。承認があってはじめて紙に代わります。

附属書V規則10.3の第二文は次のように変わりました。

The Garbage Record Book, whether as a part of the ship’s official logbook, or as an electronic record book which shall be approved by the Administration taking into account the Guidelines developed by the Organization, or otherwise, shall be in the form specified in appendix II to this Annex:

油記録簿第I部・第II部（附属書I規則17.1・36.1）と貨物記録簿（附属書II規則15.1）にも同じ形の文が入りました。船長が署名する単位には、each completed pageの後にor group of electronic entriesが付きました。電子にはページがないので、記載のまとまりが署名の単位です。

指針が扱う記録簿は七つです

2.1 These Guidelines are only applicable to the use of electronic record books on board to meet the requirements of the following record books and recording requirements under the MARPOL Annexes and the Technical Code on Control of Emission of Nitrogen Oxides from Marine Diesel Engines (NOX Technical Code): .1 Oil Record Book, parts I and II (MARPOL Annex I, regulations 17.1 and 36.1); .2 Cargo Record Book (MARPOL Annex II, regulation 15.1); .3 Garbage Record Book, parts I and II (MARPOL Annex V, regulation 10.3); .4 Ozone-depleting Substances Record Book (MARPOL Annex VI, regulation 12.6); .5 recording of the tier and on/off status of marine diesel engines (MARPOL Annex VI, regulation 13.5.3); .6 Record of Fuel Oil Changeover (MARPOL Annex VI, regulation 14.6); and .7 Record Book of Engine Parameters (NOX Technical Code, paragraph 6.2.2.7).

附属書VIとNOx技術コードの四つは、MEPC.316(74)とMEPC.317(74)が変えたものです。この記事はその二つの決議の番号だけを記し、本文は扱いません。指針の2.3は、証書のように運航を連続して記録しない文書は扱わないとしています。2.4は、船から会社へ送る資料の交換は記録簿の要件ではないと線を引きます。電子記録簿は船内の記録装置であって、報告の仕組みではありません。

第一に、欠けた欄があれば保存されず、直した跡が残ります

4.1.2 As MARPOL specifies the recording of a range of information for specific circumstances, an approved system should only allow a complete entry to be saved for verification by the master. For example, for a MARPOL Annex V discharge at sea, the entry should not be able to be saved without the entry of the latitude and longitude of the discharge. It is suggested that where possible, technology which can automatically input required data be installed to ensure accuracy. In the case of equipment failure, manual input should be allowed and the change of the source of data recorded. The automatic data value inputs should be protected by measures aimed at preventing attempts at manipulation or falsification. The system should automatically record any attempts to manipulate or falsify any data.

紙では位置を空けたまま署名できます。電子記録簿は完全な記載だけに保存を許さなければなりません。位置を自動で取り込む装置を勧めますが、装置が故障したら手入力を開き、入力元が変わった事実を記録します。操作の試み自体が記録されます。

4.3.4 Records and entries should be protected by measures aimed at preventing and detecting attempts at unauthorized deletion, destruction or amendment. After an entry is saved by the user, the system should secure the information against unauthorized or untraceable changes. Any change(s) to the entry by the same user or a different user should be automatically recorded and made visible both in the system and in any output presentation or printed versions of the electronic record book. The entry should appear in the list of entries in a format that makes it clear that the entry has been amended. To create transparency of changes to saved or verified entries, it is essential that the system is designed to retain both the original entry and the amendment(s).

保存された記載は消したり上書きしたりできません。直せば元の記載と直した記載の両方が残り、画面でも出力物でも直したという表示が見えなければなりません。4.3.5は、直した理由と直した人の識別子を記録して船長が確認するよう勧めます。紙の見え消し訂正が、電子では履歴の保存に変わります。

第二に、署名が個人のログインと船長の検証の段階に変わります

4.3.1 To ensure the security of an electronic record book, it is critical that the system implements Role Based Access Control. At a minimum, all access to the application should use a unique personal login identifier and password for each user. This level of security ensures that the user making entries into the application is accountable for any false entries or omissions. 4.3.2 MARPOL requires the signature of the relevant officer entering a record. As such, the electronic record book should implement Audit Logging. Audit Logging should record a user code, identifying symbol, such as a graphic character, or an equivalent identifier against each entry to uniquely identify the user and whether the user provided accessed or amended an entry.

担当職員の署名は、個人別のログインと監査ログに置き換わります。共用アカウントはこの条件を満たしません。誰が記載し、誰が閲覧し又は直したかが、記載ごとに残らなければなりません。

4.3.6 MARPOL also requires that information in the record book be verified (e.g. regulation 17 of MARPOL Annex I requires that each page of the Oil Record Book be signed by the master of the ship). For verification of a single or series of saved entries by the master, the electronic record book should have an additional authentication factor to allow verification. This additional authentication factor should be in the form of additional credentials supplied by the master at the time of verification.

船長のページ署名は検証の段階になります。船長はログインとは別の追加の認証を検証の時点で入れなければなりません。4.3.8は、記載ごとにpendingやverifiedのような状態欄を置くよう求めます。4.3.9は、検証の後に直せば自動でpendingに戻し、船長に再検証を知らせるよう求めます。4.3.7は記載・修正・検証の時刻を別々に残し、数日分を一度にまとめて書いた跡が見えるようにします。附属書V規則10がpromptly recordedを求めているからです。4.3.10は入港前の検証を勧め、検証していない記載には理由を付けるよう求めます。4.3.11は、受入施設の受領証や検査の裏書を該当する記載に添付又は参照できるようにしつつ、原本は別に保管するよう求めます。

第三に、バックアップは自動で、オフラインの写しには船長のデジタル署名が付きます

4.4.2 The electronic record book should have the capability to allow automatic backup of data in the system to offline storage. Backups should ensure the offline record is updated automatically every time changes are made to entries to ensure the backing up process is not forgotten by the user.

人が覚えていて行うバックアップは、指針が退けます。記載が変わるたびにオフラインの保存先が自動で更新されなければなりません。4.4.1は、電子記録簿を会社のIT事業継続計画に入れ、電源が落ちても利用できるよう予備電源を考慮するよう求めます。検査中にシステムを開けなければ、6.1.2により別の検証済みの写しか紙の記録簿を求められます。

4.4.4 This offline record may be provided in any format deemed appropriate by the Administration and should be digitally signed by the master. The properties of the digital signature need to appear on the offline record, including the title; full name of the signer; and date and time of signing. It is recommended that the document be presented in PDF; however, an alternative format may be used. Alternative formats should allow the exchange and view of electronic documents independent of the environment in which they were created and the environment in which they are viewed or printed, in a simple way and with fidelity.

オフラインの写しは暗号化されて読取り専用でなければならず（4.4.3）、船長がデジタル署名します。署名の役職、署名者の氏名、署名の日時が写しの上に見えなければなりません。形式はPDFを勧めますが、主管庁が他の形式を認めることもできます。4.1.4は、各附属書が定める最短保管期間の間すべての記録を保持するよう求めます。求めがあれば、船長が原本どおりと証明する紙の出力を作れなければなりません。

宣言書は船内になければならず、検査官は紙の出力を求めることができます

5.1 Any electronic system deemed to meet the above criteria should be provided with written confirmation by the Administration and carried on board the ship for the purpose of regulatory surveys or inspections. An example of a declaration can be seen in the appendix.

承認の証拠は主管庁の書面による確認、つまり宣言書です。附録の例示様式には、船名、IMO番号、旗国、適用する附属書、製造者・供給者・設置者、ソフトウェアの名称とバージョン、設置日が入ります。5.2は、審査と宣言書の発給を認定団体に委ねるかどうかを主管庁の裁量に置きます。

6.1.2 The use of and reliance upon electronic record books in no way relieves shipowners of their existing duty to accurately maintain and produce records during an inspection, as required by MARPOL. It is recommended that if a ship cannot produce the electronic record book or a declaration provided by the Administration during the PSC inspection, the PSC officer should request to view an alternative verified copy of the records or a hard copy record book for verification.

宣言書がないか、システムを開けなければ、PSCの検査官は別の検証済みの写しか紙の記録簿を求めます。6.2は、検査官が別の機器を持ち込まなくて済むよう、船内の機器で見せられなければならないとしています。調査が開かれれば、6.3により該当する記載又は記録簿全体を出力し、船長がページごとに署名してtrue copyとして証明します。出力物には、記載者の役職と氏名、修正の内容、出力の日時、ソフトウェアの名称とバージョン、ページ番号と総ページ数が入っていなければなりません。

確認しておくこと

MEPC.312(74)は指針なので、本文はshouldで書かれています。拘束力は、MEPC.314(74)が変えた附属書本文のapproved by the Administrationから出ます。ですから同じソフトウェアでも、旗国ごとに承認の手続と宣言書の様式が違うことがあります。4.2は、MARPOLの改正が発効する前にソフトウェアを更新しつつ、既存の記録を失ったり読めなくしたりしてはならないとしています。附属書VI側の記録簿の条文改正は、この記事では扱いません。
