IGFコード適用船の訓練の基礎・上級の二段階と、ガスタンカーの資格で代える条件（STCW規則V/3）

LNGやその他の低引火点燃料を使う船は、SOLASのIGFコードの適用を受けます。その船に乗る船員の訓練はSTCW規則V/3が定めます。タンカーの訓練と同じく基礎と上級の二段階ですが、各段階を呼ぶ基準が違います。船種ではなく、燃料に対する安全業務と責任です。

この規則にはもう一つの軸があります。液化ガスタンカーで受けた資格をIGFの資格として代える条件です。代える条件を広く読むと、バンカリングの経験がない人が上級の証書なしに燃料の責任を担うことになり、狭く読むと、すでに満たしている人に課程をもう一度求めることになります。

規則V/3は2015年6月に採択されたMSC.396(95)が新しく入れ、コードのA-V/3は同じ日にMSC.397(95)が追加しました。二つの決議は2017年1月1日に発効しました。

適用対象はIGFコード適用船で働くすべての人で、慣熟が先です

1 This regulation applies to masters, officers and ratings and other personnel serving on board ships subject to the IGF Code.

2 Prior to being assigned shipboard duties on board ships subject to the IGF Code, seafarers shall have completed the training required by paragraphs 4 to 9 below in accordance with their capacity, duties and responsibilities.

適用範囲は船種ではなくships subject to the IGF Codeです。船がIGFコード適用船かどうかが先で、その船で何を担うかが次です。第2項は時点を定めます。第4項から第9項までの訓練は、船内の業務を割り当てられる前に終わっている必要があります。

3 All seafarers serving on board ships subject to the IGF Code shall, prior to being assigned shipboard duties, receive appropriate ship and equipment specific familiarization as specified in regulation I/14, paragraph 1.5.

第3項は証書とは別に、すべての船員に掛かります。その船とその設備に合わせた慣熟です。根拠は会社の責任を定めた規則I/14第1.5項です。証書を持っている人も、船を移れば、この慣熟をもう一度受けます。

基礎の証書は燃料に対する指定された安全業務が呼びます

4 Seafarers responsible for designated safety duties associated with the care, use or in emergency response to the fuel on board ships subject to the IGF Code shall hold a certificate in basic training for service on ships subject to the IGF Code.

5 Every candidate for a certificate in basic training for service on ships subject to the IGF Code shall have completed basic training in accordance with provisions of section A-V/3, paragraph 1 of the STCW Code.

基礎の証書の対象はdesignated safety dutiesを担う船員です。燃料の管理、使用、非常対応に関わる安全業務です。職名ではなく指定です。だから同じ職名でも船によって分かれます。燃料に関わる安全業務を指定されていない人に、第4項は証書を求めません。

取得の道は一つです。A-V/3第1項による基礎訓練です。タンカーの基礎証書と違って、乗船履歴が課程の代わりになる道がありません。代わりに第6項の代替があり、下で別に見ます。

上級の証書は船長・機関士・燃料の責任者に必要で、バンカリング3回を求めます

7 Masters, engineer officers and all personnel with immediate responsibility for the care and use of fuels and fuel systems on ships subject to the IGF Code shall hold a certificate in advanced training for service on ships subject to the IGF Code.

上級の証書は三つの束を呼びます。船長、機関士、そして燃料と燃料系統の管理・使用に直接の責任を負うすべての人員です。engineer officersは機関長と一等機関士だけでなく、機関士全体です。タンカーの上級証書が四つの職名を名前で呼んだのに対し、ここでは機関部の職員全員が名前で掛かります。

8 Every candidate for a certificate in advanced training for service on ships subject to the IGF Code shall, while holding the Certificate of Proficiency described in paragraph 4, have: .1 completed approved advanced training for service on ships subject to the IGF Code and meet the standard of competence as specified in section A-V/3, paragraph 2 of the STCW Code; and .2 completed at least one month of approved seagoing service that includes a minimum of three bunkering operations on board ships subject to the IGF Code. Two of the three bunkering operations may be replaced by approved simulator training on bunkering operations as part of the training in paragraph 8.1 above.

上級の証書の要件は三つの部分です。一つ目は第4項の基礎の資格証書を持っている状態であることです。while holdingなので、基礎の証書が先にあってはじめて、その後の履歴が計算に入ります。二つ目は承認された上級訓練とA-V/3第2項の能力基準です。三つ目は1か月以上の承認された乗船履歴で、その中にバンカリング作業3回が入っている必要があります。

バンカリング3回のうち2回は、承認されたシミュレータ訓練で置き換えられます。条件が付きます。第8.1項の上級訓練の一部として受けたシミュレータ訓練でなければなりません。別に受けたシミュレータ課程はこの文に入りません。実際のバンカリング1回はどの場合でも残ります。

液化ガスタンカーの資格は条件を満たすときだけIGFの資格として代えられます

6 Seafarers responsible for designated safety duties associated with the care, use or in emergency response to the fuel on board ships subject to the IGF Code who have been qualified and certified according to regulation V/1-2, paragraphs 2 and 5, or regulation V/1-2, paragraphs 4 and 5 on liquefied gas tankers, are to be considered as having met the requirements specified in section A-V/3, paragraph 1 for basic training for service on ships subject to the IGF Code.

基礎段階の代替は単純です。液化ガスタンカーの基礎または上級の資格を規則V/1-2に従って備え、証書まで受けた人は、A-V/3第1項の基礎訓練の要件を満たしたものとみなされます。資格と証書が揃っている必要があります。qualified and certifiedです。

9 Masters, engineer officers and any person with immediate responsibility for the care and use of fuels on ships subject to the IGF Code who have been qualified and certified according to the standards of competence specified in section A–V/1-2, paragraph 2 for service on liquefied gas tankers are to be considered as having met the requirements specified in section A-V/3, paragraph 2 for advanced training for ships subject to the IGF Code, provided they have also: .1 met the requirements of paragraph 6; and .2 met the bunkering requirements of paragraph 8.2 or have participated in conducting three cargo operations on board the liquefied gas tanker; and .3 have completed sea going service of three months in the previous five years on board: .1 ships subject to the IGF Code; .2 tankers carrying as cargo, fuels covered by the IGF Code; or .3 ships using gases or low flashpoint fuel as fuel.

上級段階の代替には条件が三つ加わります。液化ガスタンカーの上級資格だけでは足りません。

二つ目の条件は選択です。バンカリング3回の代わりに、液化ガスタンカーの貨物作業3回で満たせます。三つ目の条件は選択ではありません。三つの船種のいずれかで、過去五年の間に3か月乗っている必要があります。ガスタンカーの履歴が古ければ、上級の代替は閉じます。

A-V/3第1項と第2項は、この代替をコードの側で受けます。各項の.2が、規則V/3第6項と第9項による液化ガスタンカーの訓練・証書を、課程修了の代わりとして置いています。

証書は資格証書として出て、更新は規則I/11の外で回ります

11 Administrations shall ensure that a Certificate of Proficiency is issued to seafarers, who are qualified in accordance with paragraphs 4 or 7, as appropriate.

12 Seafarers holding Certificates of Proficiency in accordance with paragraph 4 or 7 above shall, at intervals not exceeding five years, undertake appropriate refresher training or be required to provide evidence of having achieved the required standard of competence within the previous five years.

証書の形はCertificate of Proficiencyです。タンカーの証書のように既存の証書に承認を付ける選択肢は、この条文にはありません。更新は五年を超えない間隔で、再訓練を受けるか、能力基準を達成した証拠を出す方式です。

同じ決議が規則I/11第1項も改めました。

1 Every master, officer and radio operator holding a certificate issued or recognized under any chapter of the Convention other than regulation V/3 or chapter VI, who is serving at sea or intends to return to sea after a period ashore, shall, in order to continue to qualify for seagoing service, be required, at intervals not exceeding five years, to:

other than regulation V/3 or chapter VIが新しく入った言葉です。規則V/3の証書はI/11の再有効化の枠の外にあります。健康基準と乗船履歴で再有効化するのではなく、第12項の再訓練や能力の証拠で維持します。海技免状の再有効化の日付とIGF資格証書の更新の日付は、別々に数えます。

発効前からの勤務者と500トン未満の船には別の条項があります

10 Every Party shall compare the standards of competence which it required of persons serving on gas-fuelled ships before 1 January 2017 with the standards of competence in Section A-V/3 of the STCW Code, and shall determine the need, if any, for requiring these personnel to update their qualifications.

発効日の2017年1月1日より前からガス燃料船で働いていた人は、自動的に資格を認められるわけではありません。締約国が当時求めていた能力基準をA-V/3と比べ、補完が必要かを判断します。どんな結果になるかは締約国ごとに違います。

3 The Administration may, in respect of ships of less than 500 gross tonnage, except for passenger ships, if it considers that a ship’s size and the length or character of its voyage are such as to render the application of the full requirements of this section unreasonable or impracticable, exempt the seafarers on such a ship or class of ships from some of the requirements, bearing in mind the safety of people on board, the ship and property and the protection of the marine environment.

A-V/3第3項の免除は狭いです。総トン数500トン未満でなければならず、旅客船は外れます。主管庁が船の大きさと航海の長さ・性格を見て、全部の適用が不合理だと判断するときだけ、一部の要件を免除します。免除の範囲はsome of the requirementsであって、全部ではありません。

確認しておくこと

上の引用は、MSC.396(95)が追加した規則V/3と同じ決議が改めた規則I/11第1項、そしてMSC.397(95)が追加したA-V/3から取りました。この記事は二つの決議の本文までしか扱いません。どの船がIGFコード適用船かはSOLASの側の問題なので、ここでは扱っていません。

表A-V/3-1とA-V/3-2の能力項目は入れていません。課程を承認する基準、シミュレータ訓練の承認、第10項による既存の勤務者の補完の要否は、主管庁と締約国が決めます。
