保安宣言書を要請できる五つの場合と船内に置くべき保安記録十種（ISPSコードA/5・A/10・A/13）

保安宣言書（DoS）は、船と港湾施設、または船と船が保安措置の責任をどう分担するかを書き留める文書です。ISPSコードPart A第5節がいつ必要かと誰が作成するかを定め、保管期間は主管庁と締約政府に委ねます。

船内の保安記録はPart A第10節が定めます。船舶保安計画（SSP）が扱う活動のうち十種を選んで船に置かせ、言語と電子記録の条件、アクセス制限を付けます。訓練はPart A第13節です。ここで義務なのは「適切な間隔」であり、四半期に一回という数字はPart Bの勧告にあります。

寄港国管理（PSC）の検査官がISSCの次に見るのがこれらの記録です。どの記録をどの形で残すべきかを条文で一つずつ確認します。

保安宣言書が必要かは締約政府が定め、船は五つの場合に要請できます

5.1 Contracting Governments shall determine when a Declaration of Security is required by assessing the risk the ship/port interface or ship to ship activity poses to persons, property or the environment.

宣言書が必要かを定める主体は締約政府です。船と港湾施設の接点や船同士の活動が人と財産と環境に与えるリスクを評価して定めます。船が先に要請できる場合は、別に五つ書かれています。

5.2 A ship can request completion of a Declaration of Security when: .1 the ship is operating at a higher security level than the port facility or another ship it is interfacing with; .2 there is an agreement on a Declaration of Security between Contracting Governments covering certain international voyages or specific ships on those voyages; .3 there has been a security threat or a security incident involving the ship or involving the port facility, as applicable; .4 the ship is at a port which is not required to have and implement an approved port facility security plan; or .5 the ship is conducting ship to ship activities with another ship not required to have and implement an approved ship security plan.

船の保安レベルが相手より高いとき、締約政府の間に宣言書の協定があるとき、船や港湾施設に保安上の脅威や保安事件があったとき、承認された港湾施設保安計画を要求されない港にいるとき、承認されたSSPを要求されない船と船同士の活動を行うときです。後の二つは相手に計画がない場合です。相手の保安措置を計画で確認できないので、宣言書に書いておく仕組みです。

要請を受けた港湾施設や船は、その要請を確認しなければなりません（5.3）。Part B 5.2.1は、要請を受けた港湾施設保安職員や船舶保安管理者が適切な保安措置を協議するよう勧告しています。

宣言書は船長か船舶保安管理者が船を代表して作成し、保管期間は主管庁が定めます

5.4 The Declaration of Security shall be completed by: .1 the master or the ship security officer on behalf of the ship(s); and, if appropriate, .2 the port facility security officer or, if the Contracting Government determines otherwise, by any other body responsible for shore-side security, on behalf of the port facility.

船側の署名者は船長か船舶保安管理者（SSO）です。港湾施設側は港湾施設保安職員（PFSO）か、締約政府が別に定めれば陸側の保安を担う他の機関です。船と船の間の宣言書であれば、両側とも船長かSSOが署名します。

5.5 The Declaration of Security shall address the security requirements that could be shared between a port facility and a ship (or between ships) and shall state the responsibility for each.

内容は二つです。港湾施設と船が分担しうる保安要件、そして各要件の責任が誰にあるかです。Part B 5.4.1は、ここに両側の署名と日付、有効期間、該当する保安レベル、連絡先を入れるよう勧告しています。保安レベルが変わると新しい宣言書や修正した宣言書が必要になりうることも、Part B 5.4.2の勧告です。言語は英語・フランス語・スペイン語または両側に共通の言語にするというのもPart B 5.5です。

保管期間はコードが数字で定めていません。港湾施設が保管する最短期間は締約政府が（5.6）、船が保管する最短期間は主管庁が（5.7）、規則XI-2/9.2.3を念頭に置いて定めます。旗国が定めた期間をSSPに書いておかなければ、船ではいつまで置くべきか知るすべがありません。

船内に置くべき保安記録は十種です

10.1 Records of the following activities addressed in the ship security plan shall be kept on board for at least the minimum period specified by the Administration, bearing in mind the provisions of regulation XI-2/9.2.3: .1 training, drills and exercises; .2 security threats and security incidents; .3 breaches of security; .4 changes in security level; .5 communications relating to the direct security of the ship such as specific threats to the ship or to port facilities the ship is, or has been; .6 internal audits and reviews of security activities; .7 periodic review of the ship security assessment; .8 periodic review of the ship security plan; .9 implementation of any amendments to the plan; and .10 maintenance, calibration and testing of any security equipment provided on board including testing of the ship security alert system.

十種は性格が二つに分かれます。.1と.10は日付が着実に積み上がる記録です。訓練を行い設備を試験するたびに一行ずつ増えます。残りは何かが起きたときにだけ生まれる記録です。保安事件がなかったなら.2が空であるのが正常です。だから記録を点検するときは、空の項目より.1と.10の抜けを先に見ます。

期間は宣言書と同じ構造です。主管庁が規則XI-2/9.2.3を念頭に置いて定めた最短期間以上、船に置きます。

記録は作業言語で書き、電子記録なら削除と改変を防ぐ手順が必要です

10.2 The records shall be kept in the working language or languages of the ship. If the language or languages used are not English, French or Spanish, a translation into one of these languages shall be included.

言語は船の作業言語です。作業言語が英語・フランス語・スペイン語でなければ、そのうちの一つへの翻訳を付けます。自国語だけで書いた訓練記録は、翻訳が付いて初めて条文を満たします。

10.3 The records may be kept in an electronic format. In such a case, they shall be protected by procedures aimed at preventing their unauthorized deletion, destruction or amendment.

電子記録は認められます。条件は手順です。許可のない削除・破棄・修正を防ぐ手順がなければなりません。誰が直せて、直した履歴がどこに残るかがその手順の中身です。記録は許可のないアクセスと開示からも保護しなければなりません（10.4）。

Part B 10.1は、締約政府の正当な権限を持つ職員がSSPの実施を確認できるよう、記録を閲覧できるようにしておくことを勧告しています。保護と閲覧は反対方向なので、記録を見せる手順と守る手順をSSPに併せて置きます。

訓練は適切な間隔で行い、四半期に一回はPart Bの勧告です

13.4 To ensure the effective implementation of the ship security plan, drills shall be carried out at appropriate intervals taking into account the ship type, ship personnel changes, port facilities to be visited and other relevant circumstances, taking into account the guidance given in part B of this Code.

Part Aが義務として置くのは「適切な間隔」です。船種、船員の交代、寄港する港湾施設、その他の事情を考慮して定めます。会社保安統括者は適切な間隔で演習に参加し、SSPの調整と実施を確保しなければなりません（13.5）。数字はここまで出てきません。

13.6 To ensure the effective implementation of the provisions of the ship security plan, drills should be conducted at least once every three months. In addition, in cases where more than 25 percent of the ship’s personnel has been changed, at any one time, with personnel that has not previously participated in any drill on that ship, within the last 3 months, a drill should be conducted within one week of the change. These drills should test individual elements of the plan such as those security threats listed in paragraph 8.9.

数字はPart B 13.6にあります。訓練は3か月ごとに一回以上、船員が一度に25パーセントを超えて交代し、その船員が直近3か月以内にその船の訓練に参加したことがなければ、交代後1週間以内にもう一回行うよう勧告しています。助動詞はshouldです。Part A 13.4のshallと区別して読みます。ただしSSPがこの周期を取り込んでいれば、その船では計画の一部になります。

演習はPart B 13.7です。会社保安統括者、港湾施設保安職員、締約政府の関係当局が参加する演習を暦年ごとに一回以上、演習の間が18か月を超えないように行うよう勧告しています。実規模、机上シミュレーション、捜索救助や緊急対応の演習と組み合わせた形がいずれも可能です。

確認しておくこと

上の引用はSOLAS/CONF.5/34で採択されたISPSコードPart A第5節・第10節・第13節とPart B第5節・第10節・第13節から取りました。この記事はその本文までを扱います。

宣言書と記録の最短保管期間はコードに数字がありません。主管庁が定めた期間をSSPで確認します。
コードが参照する規則XI-2/9.2.3はSOLAS第XI-2章の条文です。この記事はその規則の内容を扱いません。
訓練の3か月周期と演習の18か月間隔はPart Bの勧告です。その船のSSPがどの周期を書いているかが実際の基準です。
