STCW保安資格の三つの層と適用対象（規則VI/5・VI/6）

ISPSコードが適用されるばら積み船に三人が乗るとします。甲板部員が一人、司厨員が一人、そして 船舶保安管理者（SSO）に指定された一等航海士です。三人が乗船前に備えるべき保安資格は同じでは ありません。

STCWの規則VI/5と規則VI/6は、この問いに層で答えます。層は三つです。指定保安業務のない船員の 保安意識、指定保安業務を担う船員、そしてSSOです。その前に、層を問わず掛かる慣熟訓練がもう 一つあります。層を分けるのは職名ではありません。その船がISPSコードの適用船か、その人に保安 業務を指定したか、その人がSSOかが、順に分かれ道になります。

慣熟訓練は旅客を除く乗船者の全員に掛かります

1 Before being assigned to shipboard duties, all persons employed or engaged on a seagoing ship which is required to comply with the provisions of the ISPS Code, other than passengers, shall receive approved security-related familiarization training, taking account of the guidance given in part B, to be able to: .1 report a security incident, including a piracy or armed robbery threat or attack; .2 know the procedures to follow when they recognize a security threat; and .3 take part in security-related emergency and contingency procedures.

対象がall persons employed or engagedです。船員という語を使っておらず、外れるのは旅客だけ です。定員に入らない人でも、その船で働けばここに入ります。時点も条文の中にあります。 Before being assigned to shipboard duties、つまり船内業務を割り当てる前です。

指定保安業務を担う船員には、第2項がその業務と責任についての慣熟訓練をもう一度掛けます。 そして実施の主体が船の中にあります。

3 The security-related familiarization training shall be conducted by the ship security officer or an equally qualified person.

SSOか、それと同等の資格を持つ人が行います。だからこの訓練には証書の規定が付いていません。 規則VI/6が証書に触れるのは、保安意識と指定保安業務の二か所だけです。

指定保安業務のない船員は保安意識で止まります

4 Seafarers employed or engaged in any capacity on board a ship which is required to comply with the provisions of the ISPS Code on the business of that ship as part of the ship’s complement without designated security duties shall, before being assigned to any shipboard duties: .1 receive appropriate approved training or instruction in security awareness as set out in table A-VI/6-1;

条件が三重です。ISPSコードの適用船であること、その船の業務で乗り組む定員の一員であること、 指定保安業務がないこと。三つ目の条件がこの層の天井です。業務を一つでも指定すれば、その船員は この層から出ます。証書は規則VI/6の第2項が定めます。

2 Where security awareness is not included in the qualification for the certificate to be issued, a certificate of proficiency shall be issued indicating that the holder has attended a course in security awareness training.

保安意識が受ける証書の資格要件にすでに含まれていれば、別に出ません。含まれていなければ、 別のcertificate of proficiencyが出ます。同じ層にいる二人の書類が違って見えることがあります。 違うのは書類であって、要求水準ではありません。

業務を指定すると同じ項目から基礎という語が外れます

4 Seafarers with designated security duties shall meet the standard of competence specified in section A-VI/6, paragraphs 6 to 8 of the STCW Code.

基準が表一つ分だけ動きます。動いた先の表は項目が大きく変わりません。変わるのは項目の前に付く 語です。保安意識の表は、知識の項目がすべてBasicで始まります。保安用語と定義、保安レベル、 報告手続、緊急時の計画、武器と危険物の識別まで全部そうです。指定保安業務の表には、同じ項目が その語なしで入っています。

動詞が三つです。意識は寄与し、業務を指定された船員は計画が定めた状態を保ち、SSOはその維持を 監督します。設備の項目に違いがそのまま出ます。指定保安業務の表は the need for testing, calibrating, and maintainingを求めます。SSOの表は the methods for testing, calibrating, and maintainingを求めます。

証書の構造は保安意識と同じです。規則VI/6の第5項が、同じ文を指定保安業務についてもう一度 書きます。

乗船履歴と実技の実演が付くのはSSOだけです

1 Every candidate for a certificate of proficiency as ship security officer shall: .1 have approved seagoing service of not less than 12 months or appropriate seagoing service and knowledge of ship operations;

三つの層のうち乗船履歴を求めるのはここだけです。そして履歴の要件が二つに分かれます。一つは 12か月以上の承認された乗船履歴です。もう一つは適切な乗船履歴に船舶運航の知識を加えたもので、 こちらには期間が書かれていません。第2項が資格の認定と証書の発給を主管庁に委ねているので、 会社が社内基準で代わりに判定する場ではありません。

評価の方法にも、SSOだけが違う場所が一か所あります。表A-VI/5の保安上の危険、脅威、脆弱性の 評価の項目です。

Assessment of evidence obtained from approved training, or approved experience and examination, including practical demonstration of competence to: .1 conduct physical searches .2 conduct non-intrusive inspections

身体検査と非侵入型の検査を実際にやって見せる必要があります。指定保安業務の表の同じ場所は Knowledge of the methods for physical searches and non-intrusive inspectionsです。 評価は承認された教育または承認された課程の受講から得た証拠で行われます。

履歴だけで通る道は2014年に閉じました

5 Until 1 January 2014, seafarers who commenced an approved seagoing service prior to the date of entry into force of this section shall be able to establish that they meet the requirements of paragraph 4 by: .1 approved seagoing service as shipboard personnel, for a period of at least six months in total during the preceding three years; or .2 having performed security functions considered to be equivalent to the seagoing service required in paragraph 5.1; or .3 passing an approved test; or .4 successfully completing approved training.

この節が発効する前に承認された乗船履歴を始めた船員には、四つの道が開いていました。指定保安 業務についても第9項が同じ四つの道を同じ期限で置いています。期限は2014年1月1日です。今は四つ とも閉じており、残るのは承認された教育と承認された課程だけです。

閉じていないものが一つあります。

3 Every Party shall compare the security-related training or instruction it requires of seafarers who hold or can document qualifications before the entry into force of this regulation with those specified in section A-VI/6, paragraph 4 of the STCW Code, and shall determine the need for requiring these seafarers to update their qualifications.

発効前に資格を持っていた船員をどう見るかは、締約国が自国の要件とA-VI/6を照らし合わせて 決めます。判断する主体が締約国なので、同じ履歴を持つ二人でも旗国が違えば更新の要求が 分かれます。

確認しておくこと

上の引用はSTCW/CONF.2/33の規則VI/5・VI/6と、STCW/CONF.2/34のコードA-VI/5・A-VI/6から 取りました。条文が定めるのは層と、その層の最低基準までです。

誰に保安業務を指定するかは、これらの条文が定めていません。指定した結果が層を変えるだけです。 だから乗組員名簿だけを見て層を判定することはできません。

保安意識と指定保安業務が別の証書として出るのか、すでに持っている証書の資格の中に入るのかは、 旗国の証書の体系によります。SSOの履歴要件で期間が書かれていない側をどう認めるか、訓練を何で 承認するかも主管庁が定めます。
