極海域を航行する船の航海士の訓練の基礎・上級の対象と、2018年発効後の経過措置（STCW規則V/4）

STCW規則V/4は、極海域を航行する船の航海士に掛かる訓練を定めます。適用される地域はSOLAS第XIV章が定義する北極海域と南極海域で、適用される船はその海域を航行する船です。世界共通の義務ではありません。極海域に入らない船には、この規則は掛かりません。

この規則は三つの日付の上に立っています。極海コードが効力を持つ日、STCW改正が発効する日、経過措置が終わる日です。そして二つの職名の線があります。基礎の証書は当直航海士まで、上級の証書は船長と一等航海士までです。日付と職名を混ぜて読むと、経過措置で乗船していた人がある日から証書のない状態になります。

規則V/4は2016年11月に採択されたMSC.416(97)が新しく入れ、同じ日にMSC.417(97)がコードのA-V/4を追加しました。二つの決議は2018年7月1日に発効しました。

極海域の範囲はSTCWではなくSOLAS第XIV章が定めます

MSC.416(97)は規則I/1の定義に二つの項を加えました。

.42 Polar Code means the International Code for Ships Operating in Polar Waters, as defined in SOLAS regulation XIV/1.1.

.43 Polar waters means Arctic waters and/or the Antarctic area, as defined in SOLAS regulations XIV/1.2 to XIV/1.4.

STCWは極海域を自分では定義しません。as defined in SOLAS regulations XIV/1.2 to XIV/1.4で渡します。どの緯度から極海域なのか、どの航路が掛かるのかは、SOLASの側の条文を見る必要があります。この記事はその定義を扱いません。

一つ目と二つ目の日付の間に1年6か月の隙間があります。MSC.416(97)の前文はこの隙間を知っています。極海コードの発効とSTCW改正の発効の間の過渡期には、コードのB-V/gの指針を主管庁が適用するよう書きました。そして決議本文の第4項は規則V/4を早期に実施するよう締約国に促し、第5項は早期に発給された証書を他の締約国が認めるよう要請します。

基礎の証書は当直航海士まで掛かります

1 Masters, chief mates and officers in charge of a navigational watch on ships operating in polar waters shall hold a certificate in basic training for ships operating in polar waters, as required by the Polar Code.

2 Every candidate for a certificate in basic training for ships operating in polar waters shall have completed an approved basic training for ships operating in polar waters and meet the standard of competence specified in section A-V/4, paragraph 1, of the STCW Code.

対象は三つです。船長、一等航海士、航海当直を担う職員です。機関士と部員はこの条文にいません。規則V/4の表題もmasters and deck officersです。極海域の訓練は甲板部職員の資格です。

取得の道は一つです。承認された基礎訓練を終え、A-V/4第1項の能力基準を満たすことです。タンカーの基礎証書のように乗船履歴が課程の代わりになる道はありません。条文の末尾のas required by the Polar Codeは、誰が証書を持つべきかの根拠を極海コードに置き、STCWはその証書の要件を定める構造です。

上級の証書は船長と一等航海士だけに掛かり、2か月の履歴を求めます

3 Masters and chief mates on ships operating in polar waters, shall hold a certificate in advanced training for ships operating in polar waters, as required by the Polar Code.

4 Every candidate for a certificate in advanced training for ships operating in polar waters shall: .1 meet the requirements for certification in basic training for ships in polar waters; .2 have at least two (2) months of approved seagoing service in the deck department, at management level or while performing watchkeeping duties at the operational level, within polar waters or other equivalent approved seagoing service; and .3 have completed approved advanced training for ships operating in polar waters and meet the standard of competence specified in section A-V/4, paragraph 2 of the STCW Code.

上級の対象は二つです。船長と一等航海士です。当直航海士は上級の証書がなくてもかまいません。要件は三つの部分です。基礎の証書の要件、承認された乗船履歴2か月以上、承認された上級訓練とA-V/4第2項の能力基準です。三つすべてが必要です。

履歴の部分の条件を見ておく価値があります。甲板部で、管理級として、または運航級の当直業務を行いながら、極海域の中で積んだ履歴です。二等航海士として極海域で当直に立ちながら2か月乗ったなら、その履歴は計算に入ります。末尾にor other equivalent approved seagoing serviceが付いています。何を同等の履歴と見るかは主管庁が決めます。

A-V/4第1項と第2項は、それぞれ表A-V/4-1と表A-V/4-2を指します。1列目の業務を行う能力を実演し、2列目の知識と3・4列目の評価方法・基準に従って能力基準を達成した証拠を出す構造です。

5 Administrations shall ensure that a Certificate of Proficiency is issued to seafarers who are qualified in accordance with paragraphs 2 or 4, as appropriate.

証書の形はCertificate of Proficiencyです。既存の海技免状に承認を付ける選択肢は、この条文にはありません。

経過措置は2020年7月1日まで二つの道で開いていました

6 Until 1 July 2020, seafarers who commenced approved seagoing service in polar waters prior to 1 July 2018 shall be able to establish that they meet the requirements of paragraph 2 by: .1 having completed approved seagoing service on board a ship operating in polar waters or equivalent approved seagoing service, performing duties in the deck department at the operational or management level, for a period of at least three months in total during the preceding five years; or .2 having successfully completed a training course meeting the training guidance established by the Organization for ships operating in polar waters.

7 Until 1 July 2020, seafarers who commenced approved seagoing service in polar waters prior to 1 July 2018 shall be able to establish that they meet the requirements of paragraph 4 by: .1 having completed approved seagoing service on board a ship operating in polar waters or equivalent approved seagoing service, performing duties in the deck department at management level, for a period of at least three months in total during the preceding five years; or .2 having successfully completed a training course meeting the training guidance established by the Organization for ships operating in polar waters and having completed approved seagoing service on board a ship operating in polar waters or equivalent approved seagoing service, performing duties in the deck department at the management level, for a period of at least two months in total during the preceding five years.

経過措置の入口は一つです。発効日より前に極海域で承認された乗船履歴を始めた人です。発効日より後に初めて極海域に入った人には、この二つの項は開きません。

入口を通れば、基礎と上級にそれぞれ二つの道があります。基礎は、過去五年の間の極海域の履歴3か月か、IMOの訓練指針に合う課程の修了です。上級は、管理級で3か月か、課程の修了に管理級の履歴2か月を加えたものです。基礎の側の履歴は運航級でもかまいませんが、上級の側の履歴はat management levelに狭まります。

この二つの項はUntil 1 July 2020です。その日の後は経過措置で資格を証明できず、第2項と第4項の正規の要件に戻ります。経過措置で証書を受けた人なら、その証書が正規の要件に従って発給されたものかを確認する必要があります。

五年ごとの維持は規則I/11第4項とA-I/11第4項が別に定めます

MSC.416(97)は規則I/11に第4項を差し込みました。

4 Every master or officer shall, for continuing seagoing service on board ships operating in polar waters, meet the requirements of paragraph 1 of this regulation and be required, at intervals not exceeding five years, to establish continued professional competence for ships operating in polar waters in accordance with section A-I/11, paragraph 4 of the STCW Code.

規則I/11第1項の一般の再有効化に加えて、極海域についての継続的な専門能力を、五年を超えない間隔で別に証明します。二つは重なりません。海技免状の再有効化を終えても、極海域の側の証明は別に残ります。

4 Continued professional competence for masters and officers on board ships operating in polar waters, as required under regulation I/11, shall be established by: .1 approved seagoing service, performing functions appropriate to the certificate held, for a period of at least two months in total during the preceding five years; or .2 having performed functions considered to be equivalent to the seagoing service required in paragraph 4.1; or .3 passing an approved test; or .4 successfully completing an approved training course or courses.

証明の方法は四つです。過去五年の間に合計2か月以上の承認された乗船履歴、第4.1項の履歴と同等とみなす職務の遂行、承認された試験の合格、承認された訓練課程の修了です。四つのうち一つでかまいません。履歴の部分はin totalなので、一度に2か月を満たす必要はなく、五年の間に合わせて2か月あれば足ります。

確認しておくこと

上の引用は、MSC.416(97)が追加した規則V/4と規則I/1・I/11の改正、そしてMSC.417(97)が追加したA-V/4とA-I/11第4項から取りました。この記事は二つの決議の本文までしか扱いません。

極海域の定義と、どの船が極海コードの適用船かは、SOLAS第XIV章の問題です。表A-V/4-1とA-V/4-2の能力項目は入れていません。同等の乗船履歴の認定、課程の承認、経過措置の期間に発給された証書の扱いは、主管庁が決めます。
