実質的同等性が成り立つ二つの条件とDMLC Part Iへの記載（MLC第VI条）

MLC, 2006第VI条は、Part Aの要件を規定どおり実施できない旗国に、実質的に同等の措置を認めます。二つの条件を満たし、DMLC Part Iに記載する必要があります。

第VI条は、Part Aの代替措置を採用する前に旗国が二つの条件を評価するよう求めます。承認した措置は申告書に記載します。

Part Aは強制で、Part Bは強制ではありません

The Regulations and the provisions of Part A of the Code are mandatory. The provisions of Part B of the Code are not mandatory.

コードが二つに分かれていて、拘束力が互いに違います。規則とPart Aは守らなければならず、Part Bは守らなければならないものではありません。

Each Member undertakes to respect the rights and principles set out in the Regulations and to implement each Regulation in the manner set out in the corresponding provisions of Part A of the Code. In addition, the Member shall give due consideration to implementing its responsibilities in the manner provided for in Part B of the Code.

既定の経路は一つです。各規則をPart Aが書いたとおりの方法で実施することです。Part Bは、実施の方法を選ぶときに十分考慮せよ、という位置にあります。

代替措置はPart Aを規定どおり実施できない場合に限ります

A Member which is not in a position to implement the rights and principles in the manner set out in Part A of the Code may, unless expressly provided otherwise in this Convention, implement Part A through provisions in its laws and regulations or other measures which are substantially equivalent to the provisions of Part A.

代替措置の可否は旗国が判断します。not in a position to implementはPart Aを所定の方法で実施できない場合を指し、会社や船長が便宜的に選べるという意味ではありません。

但し書きがもう一つ付いています。unless expressly provided otherwise in this Conventionです。条約がその場で別に定めていれば、この道は使えません。

具体的な除外として、MLC第5部の遵守・執行規定には実質的同等性を適用しません。検査・証書・執行要件を会社独自の同等な手続で置き換えることはできません。

同等と呼ぶには二つの条件を一緒に越えなければなりません

For the sole purpose of paragraph 3 of this Article, any law, regulation, collective agreement or other implementing measure shall be considered to be substantially equivalent, in the context of this Convention, if the Member satisfies itself that: (a) it is conducive to the full achievement of the general object and purpose of the provision or provisions of Part A of the Code concerned; and (b) it gives effect to the provision or provisions of Part A of the Code concerned.

条件の二つがandで結ばれています。一方だけを満たしても同等ではありません。

条件	何を問うか
(a) 目的の達成に資すること	そのPart A条項の一般的な目的と趣旨を完全に達成するか
(b) その条項に効力を与えること	そのPart A条項に実際に効力を与えるか

(a)は方向を問い、(b)は結果を問います。趣旨には合っていても、その条項を実際に動かせなければ(b)で掛かります。逆に条項の形をなぞるだけで目的を完全に達成できなければ(a)で掛かります。

判断する主体も条文にあります。the Member satisfies itselfです。旗国が自ら確認しなければならず、船舶所有者が出した説明がその確認の代わりにはなりません。この定義が第3項のためだけのものだという限定も併せて付いています。

採用した置き換えはDMLC Part Iに記録されます

基準A5.1.3の第10項が海上労働遵守措置認定書を二つの部分に分けます。Part Iは権限のある機関が書き、 Part IIは船舶所有者が書きます。同等の措置が書かれる場所はPart Iです。

(iv) record any substantially equivalent provisions adopted pursuant to paragraph 3 of Article VI; and (v) clearly indicate any exemption granted by the competent authority as provided in Title 3;

同じ項で(iv)と(v)が並んで置かれています。同等の措置と免除は別のものです。同等の措置は第VI条第3項によって採用した置き換えであり、免除はTitle 3で権限のある機関が与えたものです。Part Iでは二つは別の行に書かれます。

指針B5.1.3は、その記載がどの程度でなければならないかも書いています。

Where a provision of the Convention is implemented through substantial equivalence as provided under Article VI, paragraph 3, this provision should be identified and a concise explanation should be provided.

どの条項が置き換えで実施されたのかを指し示し、簡潔な説明を付けよということです。指針なので強制ではありません。ただしPart Iに置き換えが書かれていても、どの条項についてのものか読み取れなければ、検査官はその行だけを見て判断できません。

乗っている船で確かめるのはPart Iのその行です

A current valid maritime labour certificate and declaration of maritime labour compliance, accompanied by an English-language translation where it is not in English, shall be carried on the ship and a copy shall be posted in a conspicuous place on board where it is available to the seafarers.

証書と海上労働遵守措置認定書は船に積まれていなければならず、写しは船員が見られる目立つ場所に掲示されなければなりません。英語でなければ英語の訳が併せて付きます。だから船で直接できる確認があります。

Part Iに同等の措置として示された項目があるか
あるならどのPart A条項を置き換えたものか
その置き換えを収めた国内法令や団体交渉の合意が何として指し示されているか

書かれていれば、その項目は条約の文をそのまま移した国内規定ではありません。船内の手順と記録はその国内措置に合わせなければなりません。Part Aの条文だけを見て合わせた手順は、ここで食い違うことがあります。

確認しておくこと

上の引用はMLC, 2006統合版（2022年改正を含む）の第VI条と基準A5.1.3、指針B5.1.3から取りました。二つの条件とPart Iへの記載義務は条約本文なので旗国によって変わりません。変わるのは中身です。どの条項を置き換えたのか、何で置き換えたのか、その置き換えを収めた国内法令が何かは、旗国ごとに違い、船ごとに違います。その船のPart Iにそうした行があるか、あるならどの国内規定を指しているかが、実際の判断の出発点です。
