实质等效成立的两个条件与DMLC Part I的记载（MLC第VI条）
MLC, 2006第VI条允许无法按Part A原规定实施要求的船旗国采用实质等效措施。措施须满足两项条件，并记入DMLC Part I。
第VI条要求船旗国在采用Part A替代措施前评估两项条件，批准后的措施须记录在声明中。
Part A是强制的，Part B不是
- The Regulations and the provisions of Part A of the Code are mandatory. The provisions of Part B of the Code are not mandatory.
规则集分成两半，约束力并不相同。规则和Part A必须遵守，Part B不是必须遵守的。
- Each Member undertakes to respect the rights and principles set out in the Regulations and to implement each Regulation in the manner set out in the corresponding provisions of Part A of the Code. In addition, the Member shall give due consideration to implementing its responsibilities in the manner provided for in Part B of the Code.
默认路径只有一条。把每条规则按Part A写下的方式实施。Part B所在的位置，是选择实施方式时应当充分 考虑的东西。
无法按Part A原规定实施时才可采用替代措施
- A Member which is not in a position to implement the rights and principles in the manner set out in Part A of the Code may, unless expressly provided otherwise in this Convention, implement Part A through provisions in its laws and regulations or other measures which are substantially equivalent to the provisions of Part A.
是否可采用替代措施由船旗国判断。not in a position to implement指无法按规定方式实施Part A，并不允许公司或船长为方便自行选择。
后面还挂着一句限制，unless expressly provided otherwise in this Convention。公约在那个位置另有
规定的，这条路就不能用。
还有明确排除：实质等效不适用于MLC第5编的遵守与执行规定。不能通过此途径以公司自定等效程序替代检查、发证和执法要求。
要称得上等效，两个条件必须一起过
- For the sole purpose of paragraph 3 of this Article, any law, regulation, collective agreement or other implementing measure shall be considered to be substantially equivalent, in the context of this Convention, if the Member satisfies itself that: (a) it is conducive to the full achievement of the general object and purpose of the provision or provisions of Part A of the Code concerned; and (b) it gives effect to the provision or provisions of Part A of the Code concerned.
两个条件用and连着。只满足其中一个，算不上等效。

(a)问方向，(b)问结果。合乎宗旨却没能让条款真正运转起来的，卡在(b)。反过来，只把条款的形式照搬 一遍、目的没有完全实现的，卡在(a)。
由谁来判断，条文里也写了，是the Member satisfies itself。船旗国必须自己确认，船东提交的说明代
替不了这道确认。而且这个定义被限定为仅用于第3款。
采用的替代记在DMLC Part I里
标准A5.1.3第10款把海事劳工符合声明分成两个部分。Part I由主管当局编写，Part II由船东编写。等效 措施写下来的位置是Part I。
(iv) record any substantially equivalent provisions adopted pursuant to paragraph 3 of Article VI; and (v) clearly indicate any exemption granted by the competent authority as provided in Title 3;
同一款里，(iv)和(v)是并排放着的。等效措施和豁免是两回事。等效措施是依第VI条第3款采用的替代， 豁免则是主管当局按Title 3给出的。在Part I里，两者写在不同的行上。
导则B5.1.3还写了这条记载要写到什么程度。
Where a provision of the Convention is implemented through substantial equivalence as provided under Article VI, paragraph 3, this provision should be identified and a concise explanation should be provided.
要指明哪一条是用等效方式实施的，并附上简要说明。这是导则，所以并非强制。但Part I上写着等效措施， 却读不出它对应哪一条，检查官只看那一行就没法判断。
在船上要看的，就是Part I上的那一行
- A current valid maritime labour certificate and declaration of maritime labour compliance, accompanied by an English-language translation where it is not in English, shall be carried on the ship and a copy shall be posted in a conspicuous place on board where it is available to the seafarers.
证书和海事劳工符合声明必须带在船上，副本要张贴在船上海员看得到的显眼位置。不是英文的，还要附英文 译本。所以在船上有几件可以直接核对的事。
- Part I里有没有标为等效措施的项目
- 有的话，它替代的是哪一条Part A条款
- 承载这项替代的国内法规或集体协议被指为哪一部
只要写着，那个项目就不是照抄公约文字的国内规定。船上的程序和记录要按那项国内措施来对，只看 Part A条文对出来的程序，在这里可能对不上。
需要确认的事
上面的引文取自MLC, 2006综合版（含2022年修正）的第VI条、标准A5.1.3和导则B5.1.3。两个条件和记入 Part I的义务写在公约正文里，不因船旗国而变。变的是内容。替代了哪一条、用什么替代、承载替代的国内 法规是哪一部，各船旗国不同，各船也不同。那条船的Part I里有没有这样一行、有的话指向哪一部国内 规定，才是实际判断的起点。
